Further you think if the average citizen that "mistakenly" enters into someones home and kills the occupant unprovoked that they won't be arrested (or even interviewed) on the spot?

There is no crime of breaking and entering in Texas. There is burglary, but I don't think she was intending to commit a felony here. The road rage incident facts would actually be more favorable in proving someone really intended to harm another than accidentally going in the wrong apartment
