Everyone? There's multiple people just in this thread that disagree including me.
Because this board is filled to the brim with uneducated idiots who don't know the law. One borderline fascist said that the cop had every right to bash into his apartment and shoot him for suspecting he's a drug dealer by smelling the weed.
Every attorney I've heard speak about it says it's second degree murder.

How are you certain there is not something that clearly shows this was not worthy of a murder charge?
She busted into his place and shot him with the intent to kill when he was minding his own damn business. That is murder.
quote:
Again, from what I've seen she did not mean to kill the guy.
Then you live in Cloud Cuckoo Land.

You're arguing premeditated vs. not. Premeditation is not required for 2nd degree murder in Texas.
There's no evidence that she opened the door with the intent of killing the person inside, but when you pull a gun and shoot at someone you can't act surprised that they died.
If she argued that she pulled the gun out to place it on the table like she always does and it accidentally discharged, that would be a different story. Convoluted and not very believable, but different.

Are you arguing intent? You sound foolish

2nd degree murder qualifications were posted on the last page. Former judges, prosecutors, and current defense attorneys all agree it should be 2nd degree murder.....because it is.
She should've been arrested on the spot, charged, and locked up. It's a very basic case tbh

I'm arguing second degree murder. It was not premeditated, but she pulled the trigger to intentionally kill him.

The way they are handling this case is absolutely criminal.
This is why we should not have police, policing themselves.
The more that comes out, the more it is becoming clear that they are trying to minimize the damage to her. No search warrant for her home that is now vacated, 2 days before questioning, and even their wording in the affidavits.

LEO are trained to shoot to kill, not to wound. If she fired her weapon she meant to kill him.

Could it be possible that she gave them permission to search her apartment? Maybe they took the doors to download the lock data off site?

An attorney for the family of a man shot dead by a police officer in the man's own apartment said a police affidavit shows investigators immediately sought evidence to discredit the victim. "They immediately began looking to smear him," said Lee Merritt, who represents the family of Botham Jean, who was shot dead in his own Dallas apartment Sept. 6.
quote:
A police affidavit shows that officers seized, among other items, 10.4 grams of marijuana and a marijuana grinder from Jean's apartment. Merritt said the search warrant showed investigators were immediately looking for drug paraphernalia, CBS Dallas / Fort Worth reports.
A police officer broke into the wrong apartment and killed the citizen who legally occupied that apartment.
A small amount of weed will not change the events and that police officer is going to prison.

The station is a simple jog from there. I would bet by the end of the night 50 uniforms came running. All it took was 1 to plant confiscated shite. News which came out the same day as his memorial, no less

I think they describe it as “shooting to stop the threat.” But that’s just semantics because a dead person doesn’t pose much of a threat.

So who would you recommend handling the investigation? Because the Texas Rangers are lead. Which is, you know, actually not the police.

We're taking the killers work that it was not premeditated. Until I see an investigation proving they didn't know each other, I'm not ruling out murder.

You can continue to say this all you want, but the fact of the matter is it only takes one Juror and I'm equally as probable to be a juror as you are in these cases.
The same people screaming about how Marijuana has nothing to do with this are also screaming that our jails are too full.
This lady is dumb, she is going to jail. I don't see why its that absurd to think that she was only in that apartment because she was dumb, and had no ill will or intent to actually murder him.

I suppose you think shooting someone repeatedly at center mass is shooting to wound?

Which is pretty fricking terrifying.

Because you’re dumb and don’t know what Second Degree Murder is. I agree that you are unqualified to be a member of this jury.

Its a fricking joke that police released information that the victim had a small personal amount of marijuana in his apartment. That is completely irrelevant to the situation. Period.
I agree with everything else in your post, but the police didn't release the information about the weed. The media did, they just did it in a way so as to frame the story a certain way.
