Oh and I'll go ahead and call it now.... knocked down to manslaughter, 5 years with time served so by that time it'll be 3 years, 2 of which will be suspended and he'll spend 1 year in the slammer and 4 years supervised probation. Bank on it.

That’s the exact thing I said 50 pages ago. Seeing some of this new info has made me question that prediction a bit, but i’ll stick with it...

Thought it was discussed earlier that settlements can’t be made in these cases?

No, it can't.

Its a criminal case, not a lawsuit. People settle lawsuits.

There is no settlement to be made here. The city presses the charges, not the victim's family. The city will be paying for the prosecutor in the case on behalf of the family of the victim.

I think this is correct at least.

There's a kid, a little younger than Garret, was part of a gang of four that broke into a motel room in Alexandria and beat a drug dealer to death. He is the grandson of a state senator, wealthy family, did not take part in the actual beating, testified against the others and plead guilty to manslaughter. The victim was not as sympathetic as this one and the kid still got 15 years.

Garret has no one to testify against, there are eyewitnesses, and possibly video footage. He'll get at least 15, maybe more.

The OT is one of the worst places in the world for legal advice

It’s going to be difficult bordering on impossible for a coroner to prove the specific type of blunt force trauma particularly with a deceased already in very poor health who died from ICH.

Don’t know about the law, but I’d guess the severity of the charges that stick and go to trial depends on the credibility of the witnesses and whatever tape might be available. That’s just a guess on my part, though.

Baw, the OT went to Harvard in its spare time between benching 400 and banging 9.5s.

Since he was intoxicated and didn’t know the dude was gonna die obviously, I doubt Ward excercised his right to remain silent upon his initial arrest. His own words will likely be used against him as well.

That's up to DA and jury not victims family

That isn't really close to this situation at all. You're not going to get much leniency if you're part of a group that went and broke into a motel room intending to kill a drug dealer

Agreed.

Didn’t think you can “settle” murders with the victims family though.

That wasn’t my point. The point is that the prosecutor does not work on behalf of the victim’s family.

No, a public defender would be assigned to Garrett if he isn't able to afford or find a lawyer. I hope for his sake if he believes in his case that he's hired his own attorney. Public defenders are like bargain basement lawyers.

ETA: Not trying to shite on public defenders either, they have a very difficult job and serve society in very important ways.

I misread what you said but to be fair you went back and had to edit it for clarity. The “he” being both sides can get confusing

Not technically,as they will be working for the jurisdiction in which they reside, but they will be arguing the case from the perspective of the victim's family. So, in a way they will be working on behalf of the victim's family.

Is Ward bonded out yet? Does his family have the means to get him out tonight?

I would have figured all this would have been arranged before he turned himself in.

No way I’m turning myself in unless my bond is already in place.
