Had this happen with Geico. They paid my truck claim and my pain and suffering. Then they sued the guy to make payments for the deductible. Got like 4 different checks till he paid it off.

Edit... No rate increase. I think it's illegal on uninsured motorist claim. Not sure about that but my brother worked for Geico in AZ and helped me through my process.

Naw.

But they probably gave you a ticket for expired brake tag

Seriously, if you are within 2 years from the date of accident there is still time to bring a claim for personal; injuries, unless you signed a general release. In which case you are screwed.

Regular UM coverage is for injuries. Your collision coverage would apply here for vehicle damage. UM coverage comes into play if your kid or their passengers have injuries.

Don't hold your breath on your insurance company getting reimbursed by the at-fault driver or getting your collision deductible reimbursed. If he didn't have insurance, he's more than likely poor and the insurance company would be wasting their time/money on going after the guy or suing him to get reimbursed.

Your premiums should not go up for a not-at-fault accident. Premium may still go up due to an overall rate increase, but that would've happened regardless of this accident.

Deductibles? I just went and rechecked. My policy has zero deductible if I'm hit by an un or under insured driver.

I didn't think I remembered paying a deductible either time, but checked to make sure.

Collision deductible would apply. But its possible that you have collision coverage with zero deductible. You just pay higher premium for it.

ETA: Are you reading the part about uninsured motorist coverage or collision? Regular UM is for injuries, not property damage. There is no deductible for UM (injury). Collision coverage is where you're looking to find out your deductible.

Some states mandate property deductibles for um coverage.

In AL, there is no UM property coverage. Either you have comp and collision, or you are screwed if an uninsured motorist is at fault.

In the two accidents I had, there was no property damage beyond our vehicles, and no medical claims. Once was actually fairly minor, cost about $2K to fix my truck and that was it, the second was a bit more major in that my truck ended up being totaled because of the cost of repairs but there were no injuries.

In either case, I don't remember paying a deductible, but it has been several years so it's entirely likely I'm just not remembering the details entirely correctly.

I’m assuming he’s filing a UMPD claim bc he said he had a deductible, and UMPD would apply if he doesn’t carry collision (with the other driver being at fault) in this case.

I waived UM. A few years ago, I was rear ended by a motorist who had an insurance card, but State Farm had trouble contacting the insurance company and felt the insurance card was fraudulent. The driver was an undocumented immigrant and the state trooper said its common for them to carry invalid insurance cards. Paid my $250 collision deductible, and since I was not at fault, State Farm told me my premium would not increase. About a year later, State Farm sent me a $250 reimbursement check. Apparently they got their money somehow. I need to read up on UM, but it seems like a scam.

I’ve never heard of UMPD not having a deductible. Typically its $250

ETA: at least in LA. Can’t speak for other states

Don't know what's been said already but often the carrier gets the monies back through subrogation. Can be a lengthy process though. Your rates should not go up due to that UNLESS you have some sort of accident free/claims free discount so while they will not rate the incident per se, the discount might be removed which would indirectly cause a rate increase...

In Arkansas that is exactly what happens if you get pulled over and don't have insurance. Your vehicle gets towed to impound. Used to be they would let you have someone else show up and drive it home or whatever, but not any more, you drive without insurance and get caught, you're looking at a tow bill and more.

Driving in Louisiana without UM coverage is like screwing a meth head prostitute without protection. Sooner or later it's gonna get you. UM is not a scam. Generally protects you if injured by an uninsured or underinsured driver.
