Really, get an attorney. Similar thing happened to my husband, but thankfully he was not injured. It just messed up his car. He never got anything from the guy that hit him, who had no insurance, and had just allegedly bought his truck (but it was still registered to someone else). The guy had to do nothing more than pay a fine after the court hearing. Never even went in front of a judge. The Prosecutor let him just pay the fine and leave. I asked the Prosecutor about our getting reimbursed for the deductible and he said we would have to sue him. We didn't. He was a loser with nothing.

shouldn't something be notarized, taken to DMV etc...
Why does the father still show as owner in the VIN report?

Well, if it isn't his car, I don't know it matters. But these guys do this all day every day, it doesn't matter if you have a policy thru the same company.

Maybe I'm ignorant with this stuff, but why pay for an attorney to sue someone who can't even afford insurance?

In MS
You must register a car within 7 days of taking possession of it. If you are a new resident you must do this within 30 days.

Visit your county tax collector's office, and bring the completed title/registration form with you and the bill of sale with you. In addition, you will need to provide proof of insurance

Correct. But what's the point? They are going to say...we'll we can sue him but since he can't even afford $100-$200/mo in car insurance, the likelihood that we are going to collect is small.

Maybe, but wouldn't you feel better getting that advice from a licensed attorney than an insurance adjustor who more than likely never stepped inside of a law school?
