Gotcha...must just be an underinsured situation. Thanks for clearing that up.

my medical insurance maximums are much higher than any UM motorist coverage, and I pay enough for that a month.
Mine too but how much UM should I have? I just looked and mine is $88.10/yr for $25K each person and $50K each accident.

We just went through this in Georgia.

1. File against your insurance company for your loss. Insurance company will go against the other driver.

2. For the personal injury, hire an attorney, though good luck getting paid, even if you get a judgement.

The problem with injuries in auto wrecks is that your personal health insurance (if you have it) wont want to pay for your healthcare. They will say since it was an auto accident, you need to file it against the auto policy medical cover. yours or the other guys. The other issue is that doctors a lot of times wont accept your health insurance at their office for just this reason, and will insist you pay as a cash customer.

Its really a major problem unfortunately.

so your liability is 100/300 and your um is 25/50?

Think about it this way. If someone hurts you, how much protection do you want?

Yeah, you have to cram it down their throats sometimes. There is no exception for your health insuror paying for medical treatment from auto accidents. They just get subrogated.

It's possible (but not inexcusable) that the moron didn't know the dad cancelled the insurance.

Lawyer up. Looks like a possible lawsuit against pops and son. I hate lawyers, but if you don't, both could skate and leave you holding the tab.

Yes it will - I don't carry medical coverage on my auto insurance for the simple reason I pay for health care insurance, why pay twice for medical coverage.

I had an accident last year where I jumped over the side of my truck and lets just say I missed landing on my feet (actually landed on my head). The insurance company requested more information and wanted me to file it against my auto insurance. I had no issues with BCBS once I was able to show them I didn't have medical coverage on my auto.

You still should have sued and garnished his wages. If he was married you should have garnished his wifes wages as well

My son was injured a few years ago and BCBS sent us letters for the next year trying to get info so they could go back on the homeowners insurance where the accident happened. I told them I wasn't providing them anything and they eventually gave up

This thread is full of so many idiotic statements. For those of you who don't work in the industry you should probably just be quiet because 90% of what is being said on here is not true or many different things have to happen for this to apply.

Trust your claims adjustors or if you don't, contact a lawyer, not the OT.
