Unclaimed property -- Louisiana Treasurer

My father died in the '90s, and the state unclaimed-property site shows almost $800 in oil-royalty payments sitting in limbo. The Treasury office finally responded to my claim after three months, and they now want "a copy of the complete judgment of possession" for my father's estate. Question: Do these properties need to be listed on the judgment of possession in order to collect the money? I will have to check the judgment to verify, but I'm pretty sure we didn't even know this stuff existed at the time of his death. Any assistance from anyone else who has claimed money in the past is appreciated in advance. Otherwise, I can conclusively link my father to the addresses associated with these royalty payments.

The property doesn't need to be itemized (I don't believe). You just need to show you're the rightful heir or executor of the estate.

I claimed some funds last year on an old insurance policy and in process of a separate claim now. They take forever to respond no doubt. My gut is the delay has to do with the state's budget problems, thinking they've dipped into the unclaimed property funds like everything else but who knows.

I'd agree with that. Things get left off judgments and deeds quite often. That's why there are correction instruments, and anybody who runs title knows how common they are. It's called curative title work.

Yea and like he said, there's no way to know about the unclaimed property to include in the estate anyway. Otherwise it probably wouldn't be unclaimed!

That site is fun if you're real bored....look up all your family and friends etc and see if they have some $ there. I found 3k+ for my mom, old homeowners insurance premium refund. She's lived in the same house for 40 years so I have no idea how the insurance company couldn't locate her to send the refund check but she got it now.

That would be correct. The money goes into the general fund where it can be spent indiscriminately even though the state never actually has any claim to any of the money.

That general fund is the most illegal legal thing Ive ever heard of. Basically a free pass to Ponzi. Unreal. Do you know if state income tax/refunds are from general fund also? Might explain why state takes to long for that too.

If I remember correctly they are. Some of the income tax money goes to other places obviously, but the refunds they pay back are taken from the general fund. It takes three months to get your refund because it takes three months for them to find your money.

Make sure after you claim the $800 you send the same judgement of possession to whichever company or companies put that money in suspense so they can start paying you and any other heirs directly

I work in this line of business (oil and gas) and I deal with numerous JOP's when I am running title on property.

The property does not need to be listed in the JOP. Just need to show the heirship of your father.

I always put a catch all paragraph at the end of my JoPs to cover non-listed property. You probably have the same on yours.

Thanks for the reminder to claim some very old paychecks from 2006 Had to spend about an hour figuring out an easy way to get proof of my address back then. Luckily the last year of the IRS transcript I could get had it.

Either you or I have a different idea of what a general fund is. As far as I know, every state and the federal government have general funds, which are all non designated funds that the governmental entities collect. Typically this will account for most, possibly all funds collected. The use of those funds are what the biggest part of what the budget process seeks to designate.

Now our "rainy day fund" does look a lot like a slush fund at times.

It's not the general fund that I have a problem with. Obviously they are going to have a fund that is not committed before the income is received. It's what is included in it that many have a problem with. Unclaimed property is never owned by the state, but they include it in the general fund and spend it into oblivion and when owners try to claim it the state can't come up with it. The part that absolutely infuriates me is how the state acts like they are doing you a service by collecting your property, spending it like it's theirs, and then returning it to you at the time they see fit.

I'm so glad that our posters have so my knowledge about financial accounting and governmental accounting procedures. Its refreshing that you can add value to the discussion - rather than general complaining which requires zero effort.

He means heir or legatee, not executor. An executor is something completely different.

it definetly has to do with the budget, but it's more they don't have the manpower or the processes to quickly handle this stuff.

I deal with LDR a lot. You would be amazed how much stuff is a manual process. And when they have hiring freezes, and the people staying work 8-330...
