Trend towards non-prosecution/penalty reduction for theft

This trend is a societal surrender that hurts the working poor (especially in places where they basically stop prosecuting petty theft). In Dallas, you generally have to steal more than $750 to be prosecuted. So, some minimum wage worker has a $100 item stolen - something he worked over ten hours stolen by someone who likely hasn't worked a day in his life.
Theft should be aggressively prosecuted. There are plenty of other crimes that we can stop prosecuting.
Friend's wife, a very good singer, saved up $20k in cash over the years so they could have a great anniversary trip. Some woman they trusted stole it from their house, and was convicted (they have only gotten a minimal amount of restitution). Their anniversary trip ended up being to Beaver's Bend in Oklahoma.

In NOLA they really aren't prosecuting grand theft auto. That's why it has gotten so popular in Lakeview area because the perps know not much will come of it even if their caught. NOPD is ordered NOT to chase supposedly, I dont know if thats true or not.
Auto theft happens in Jefferson too of course but perps know to stay in Orleans to commit the crime. Seems NOPD doesn't care if whitey gets his shite stolen.

You don't pay taxes on money sitting in a checking account at the bank.

Or a safety deposit box.

If they kept $20k in cash lying around their house they deserve to have it stolen

So you're starting to understand the Medieval Mindset towards crime eh?
Rather than continually deal with miscreants they opted to just off them publicly in the most gruesome manner they could imagine. Theft and robbery and other crimes were kept in check this way. Forget rehab and probation and incarceration. Cut costs, cut crime,... cut criminals to pieces!
For the Tree Hugging Green Dealers out there who advocate for culling humanity to ease the human impact on climate, here's a good starting point: criminals.

I wouldn't keep that kind of cash in the house, but people keep $20k jewelry in the house so it is all relative.
The thief in that case was a friend that had some dire personal circumstances and they helped her out - a lot. They weren't repaid very well.

Correct, but you can't think of any way that putting cash in a bank account could cause you to pay taxes that you wouldn't otherwise pay had you kept the money at home?

quote:This trend is going to end up with people getting shot because the criminals will become bolder and steal more if they know they won't get prosecuted and the victims are going to get fed up and fight back. Then we'll see families on TV talking about how good of a kid he was and he was just trying to get money to buy textbooks for community college.

No one deserves to have anything stolen. Regardless of "smart" choices, a crime like this is not on the victim.
Just like,it should be okay to drive anywhere at anytime of the day or night.
You leave a wallet on a train in Tokyo, passengers will pick it up and make every effort to return it to you, everything still in it.
We've got a seriously bad culture problem in America, and it's not helped with attitudes like "the victim deserved it" along with lax punishments.

How could they prove that the thief took 20,000?

This trend is called "Restorative Justice" in the Progressive circles.
It is one more thing that the liberals are doing to try to upset our way of life.
They have been getting their people elected to District Attorney jobs around the country based on this ideology. Look at Dallas, Baltimore and other locales. It will continue until people get fed up with being robbed, beaten and otherwise violated by repeat offenders. Then the pendulum will swing back.
We are way at the left end of the pendulum swing now (I hope) and I can't wait for it to return to the other end.

I agree with you chin, as a lawyer, what would be your speculation be on how this might effect the "stand your ground" type laws, say a homeowner walks in on the perp who has just bagged up $750 of loot, the homeowner is startled, thinks maybe the unsub has a gat and busts a cap in his arse and kills him, as it stands, in some states, homeowner is justified in his actions but perp wasn't committing a crime(at least a prosecutable one?)
