In something like the Byron Smith case where the guy neutralized the teens breaking into his house and taunted them after they were already completely neutralized and then execution style took them out. You aren't going to get a break from that like the case above. The case above could go either way depending on jury and prosecutors. Byron Smith screwed up recording his dumba** doing what he did, which was well passed threat neutralized.
Man, I must have somehow missed the boat on that case (or just not remember it). But even after reading about it and listening to the audio of him killing them, I still am not sure he needs to spend the rest of his life in prison. They broke into his home and he defended it. Yes, what he did was maybe extreme (but even that's arguable depending on what side you take), but it goes back to my point above where if you break into someone's home willingly and intentionally, then anything that happens after that is sort of on you. Was he cruel? Maybe. But he was lawfully in his own home defending it after multiple burglaries there.
Obviously the recordings fricked him in the end. But even in the audio he's saying that he feels safer and lives less in fear than he did before wiping out those assholes. I find it hard to have sympathy on the kids he killed simply because he shot them too many times and called them vermin.

The big dude had it coming no doubt, but I counted seven shots, four or five of which came when the guy had gotten off him and was running away. The angle of the big guy trying to run and being shot while flailing in midair is pretty damning. Going to be a tough court case.
Skinny dude said he practiced. When it happened he was a little enthusiastic.

Dude was a nutjob that didn't even bother to call police until the next day. He deserved what he got for the way he went about everything. That was a clear over the line of self defense. Recordings definitely ruined any chance of had of a defense.
I have no sympathy for the robbers though, they deserved to be shot for breaking and entering. As law abiding people though, we need to hold ourselves to better standards than this nutjob.

It's like Snickers: it really satisfies.

I agree that was the most damning thing against him, no question.

'm all for defending yourself but actions like this can land you in prison depending on the location and DA in charge.
Nope. Rule #1 is pull the trigger until you are sure the threat is neutralized.

Is that self defense or is Skinny Pete in prison for life ?
I'd love to know what happened to Skinny Pete. If I'm on a jury, not guilty.
I mean, if the big dude approaches a cop like that the cop is taking the big dude down too. It should be not different between cops and regular citizens trying to defend themselves.

That changes it from defense to homicide.
That's up to a jury.
The threat could have come back.
It's completely arguable.

I was expecting this to be another Big Lee thread.

I just read the follow up story on Skinny Pete. The DA did not prosecute. Self defense.

It's always best to go around being polite. Stuff like this is easy to avoid. I too am a big dude.
But I'm a polite big dude. Don't go looking for it- lest you'll eventually find it.

I'd agree with that. Adrenaline is very hard if not impossible to shut down when your life was on the line seconds earlier. The smaller man may very well have ended up beaten to death or with severe life altering injuries, had he not put a stop to the clear aggressor. A large, violent aggressor. Who is willing to leave their life in the hands of such a person?
Just my take.
