Texas bartender charged with over serving man that got DUI and killed police officer

“Cala Richardson, 26, is charged with one count of sale to certain persons, a misdemeanor, in connection with the Nov. 7, 2021 death of Euless police Det. Alex Cervantes, the Lake Worth Police Department said. She was arrested Friday.

Molina's blood alcohol level was twice the legal limit at the time of the crash, authorities said.

Richardson was released from police custody after posting a $1,000 bond. She faces a year in jail and a $4,000 fine. “

If they’re going to start charging bartenders for customers twice the legal limit, there won’t be any bartenders or wait staff left.

I have always thought these are dumb/unfair. Twice the legal limit, which I assume is 0.08 there (as elsewhere), is only 0.16, and is really easy to obtain.

I deliver Door Dash from time to time… the app tells you it’s illegal to drop a alcohol order off to a intoxicated person… I ignore that… no way I’m arguing with a drunk person at their door about them being too drunk to receive a order they already paid for

Not speaking about this case itself, but shouldn't bars and restaurants track alcohol to individuals and cut them off and not allow them to leave if intoxicated to drive?

Theyve been doing various levels of this for over 20 years at this point. Every bartender (atleast in LA) has to sit through some cheesy videos that constantly repeats that you will be jailed and shamed if you serve someone more than 5 miller lites

To a degree sure but unless you are going to require them to hit people w/a breathalyzer every time they order a drink I'm not sure how you are supposed to know if they are at the legal limit for driving.

On top of that, how your BAC goes up and down depends heavily on so many factors that it's pretty much impossible to guess how many drinks it will take to get any one per above the legal limit. One of my friends had a breathalyzer in college and we'd blow in it to see how high our BAC was for fun at parties. One of our friend could have 5-6 beers in an hour and would still be under .08 while another one would be well past it after nursing just 2 beers for over an hour. It was a total crap shoot.

The best a bartender can do is try to hear if they are slurring or look wasted which isn't exactly an easy thing to do in most bars since they tend to be dark and loud.

Think through that a bit more. Think logistically how this is supposed to happen and also define how far the bartender is required to go in order to stop someone from leaving/driving

ETA also how are they tracking who is driving and who isn’t?
