Once it went from banging on the door to a window being busted in, that's when the line has been crossed and any reasonable person would think whoever is on the other side of that door has bad intentions.

Ehh. My nephew was 6 when he broke a window while knocking on my mother's door once. My mom's was an older (1890-ish) house, so maybe the glass broke more easily

Each states laws are different. In general though any part of the body or item being held which is then considered an extension of the body that breaks the plane of a door or window into a home or vehicle is considered "entering".
Many states have laws that allow for higher level of force including deadly force during self-defense after dark. The ability to discern possession of a weapon and harmful intent in the dark of night is reduced.
In Tx and La this is a open and shut case of self defense under the castle law. In Massachusetts, this fella may have some problems.

That's fine. I'm not going to argue you're wrong for thinking that way, and despite my recent reputation, I'm not being contrarian just for the sake of it. I just believe some people are too quick to give a pass to every legally justifiable shooting. As I say nearly everytime it is discussed, a legal use of deadly force does not always equal a moral use of deadly force.

And I think too many people make excuses for the criminals in these instances. This particular situation is way more unfortunate than most, but this type of incident also happens extremely rarely.
With each justified shooting, hopefully criminals start to realize that they might die committing whatever crime it is they're planning to commit.

I rarely agree with you, but I think this is right.
This whole thing is really unfortunate.....it's too bad the guy didn't think to fire a warning shot. I think they would have ran off after that.
Didn't the article mention that state laws may NOT be on his side?

The point you don't understand is that such laws are designed to trap those who would be otherwise lawfully defending themselves. You should research the history of duty-to-retreat laws before making another assumption that won't end well for you.

The criminal laws of this country were predominantly written based on Judeo Christian values and morality. Your personal agreeance or disagreeance with another persons legal and moral decision to use deadly force does not make their action amoral.

Totally agree. Had he looked out a window he might have saw they were drinking and a bunch of kids with no weapons but he chose to shoot. I mean if the kid was climbing threw the window after being warned then so be it but to just shoot because a window broke.

When I was a senior in HS, my buddy and I went up to Ole Miss to stay with my sister and party.
She lived in one of those townhouses that all looked alike. My buddy got way too drunk at the bar, took a cab home, and went into the wrong house. He went into the room he thought was the guest room, got naked, and went to sleep under the covers.
Well, that was a random girl’s house and her bedroom. She got home and saw a naked stranger in her bed.
Instead of calling the cops, she slept on the couch and when he woke up the next day he was confused as frick. We found him walking around the parking lot trying to figure out what place was my sister’s
Could have ended BADLY. She thought it was her roommates friend or something.

These are two totally different cases. If I was sitting at home at like 2 a.m. and my door opened up because I'm a dumbass for not locking it, then I'm likely going to be in total shock and have a few seconds to realize it's someone who has been drinking.
At 1 p.m., that is not something I'm willing to risk. My parents house was targeted for theft when I was in high school during the day when they were away at work, which is much more logical then breaking in while people are almost certainly in the residence at night.
If I'm at home during a weekday and I hear my front window get busted in the first thing I'm going to think is that it's a burglar and I'm grabbing the gun near my bed, not because I want to use it, because I'm sure it would suck to live with killing someone on your conscience for the rest of my life, but because I'm going to be worried about MY livelihood.
