yes, he had to get up from his desk and go to her desk , steal the phone and dig through it to find pics.


hell the kid's own parents are on the teacher's side.

Later, she was told what had happened, and checked with the student’s parents who she said were 100% on her side.

So this qualifies whether someone knowingly accessed someone else's property aka theft? How hard it was to access?

Guy steals a car because someone left it unlocked. Welp it wasn't hard to access and they got it back so nothing to see here?

No, that's absurd...and has nothing to do with what we're talking about.

My vehicle doesn't have contents in it that are not allowed where its parked.

Let me ask you, if your vehicle is in a school parking lot that is a gun free zone and someone breaks into your car and steals that gun then turns it in to the principal, are you saying you shouldn't get into any trouble for breaking the rules based on a technicality becuase someone broke into your car?

But in general, yea if the kid had to hack into her phone bypassing security stops, yea it's a huge freaking difference than if nothing is protected and he could very easily access content not allowed at school. Obviously

Better comparison since one is a felony, and the other is an implied no-no to have.

If I leave my house unlocked, that does not imply that someone, anyone, can come inside and take my things for their own personal use. While it's prudent to lock a door (or a phone) not doing so does not mean that I'm giving consent for others to take my property.

So if a kid hacked into her phone and found those pics, she shouldn't get in trouble?

Apparently, having nudes on your phone is perfectly fine as long as someone can't get access to them easily?

So which is it? Is it ok for her to have nudes or not?

Degrees of wrong is irrelevant, the only question is whether it is wrong/against the rules.

I'd love to see the list of policies you'd have to create to literally cover every single possible incident to appease.

Like possessiong porn for a teach at a school with minors is all hunky dory, no big deal. Sure thing.

It doesn't matter how easy it is to access it. If you knowingly take someone else's property without their permission, you have stolen that person's property. I think I've read anything that said, "it's not really theft if it's easy to take. Next time make your stuff difficult to take and we'll call it theft."
