Interesting question and your getting some interesting responses.

One thing not mentioned is that it is also a federal crime for a felon in possession of a firearm.

This law is being litigated in 2 separate Federal circuits. The St Louis based 8th circuit has ruled it constitutional while the Philadelphia based 3rd circuit has ruled it unconstitutional. A Petition for Writ of Certiorari has been filed with the US Supreme Court. Because of the circuit split, the writ is like to be granted and the US Supreme Court will hear the case.

This issue has not been litigated in the 5th circuit, which includes Texas. Considering how the 5th Circuit ruled in the Rahimi case that individuals under a domestic restraining order does not lose his 2nd Amendment rights( case has been argued and is awaiting a decision from the US Supreme court,) I suspect the 5th circuit would rule the felon in possession of a firearm to be unconstitutional.

Thank you. Possession of a firearm =\= handling of a firearm being used in a lawful manner at a gun range.

If that was the case, I couldn’t use my friend’s M-60 or M-249 machine gun at the range because the tax stamps for those are sure as hell not in my name.

I can’t take those weapons and go gallivanting off with them without him. Unless they were owned by a trust that I was a member of. They are not, so I cannot possess them.

But he is surely within legal bounds to hand me the weapon, stand there with me, and allow me to operate them.

Now, devil’s advocate- if y’all somehow happened to kill someone, blow something up, and generally cause the police to be involved- you can damn sure expect that once they find out your pal has a felony conviction, the good ol DA will absolutely try to tack on a gun possession charge to him. At a minimum, I would think the local police would arrest him. So, plenty legal BS that no one wants to screw with.

If your pal is such a good boy, why wouldn’t he say- “Hey man, I can’t play with guns anymore- so y’all go shoot, and I’ll stay back at the house, or, I’ll come with y’all but won’t shoot”

If I was the owner in that case, I would say- screw it man, no one is coming out here and I don’t care if they do.

FYI- I have property with a private range and once- a loooong loooong time ago- waaaaaay past the statute of limitations and the offender is deceased now- we were making such a mini Fallujah, a neighbor called the police…neighbor is a relative term here…we are talking about half a mile away and across a bayou.

Police come out, try- rather unsuccessfully- to sneak up on us- it was very comical- they got their cruiser stuck and then tried to hoof it through unknown woods- it was really silly. We see them approaching- from behind the backstop- I start waving so they know we see them- best policy with a bunch of folks with guns is to show you mean no harm. They wave back and approach us. Offender was in possession of a very illegal suppressor which he had smuggled in from South Africa. When the police determined we were there lawfully, they were quite thankful in how we politely and professionally behaved- and we brought them back to the stuck cruiser.

In other words, don’t start no shite, won’t be no shite.

It seems illegals now days can have firearms.

Yes, it's stupid for him losing his gun rights, but you don't want to potentially foul something up.

If something should go wrong, you don't want to compromise your friend in Texas.

I wouldn’t say anything. If something happens, the owner can say he had no idea and it’s all on the dude. If you tell him, then you are actually putting a burden on the owner. 99.999999999999999% nothing would ever happen anyway, right?


ETA: just saw that he’s still on probation. That changes the equation drastically.

The land owner should be made aware of this. If he is letting people use his gun range at least respect him enough to inform him of any situation that could somehow put him in the middle of something he shouldn't be. Don't be an immature prick.

Why would you not expect your Felon dindu buddy to be the one who lays his cards on the table with the landowner?

Or at the very least, if he prefers not to divulge his past, but truly wants to correct his life, why does he not just decline problematic invites 'til his probation expires/legal situation improves?
