First of all, it’s not just an ordinary toy gun, but it’s a squirt gun. The squirt guns existed before water bottles were commonly marketed, so the kid was drinking some water from his squirt gun, which was actually not unheard of use of squirt guns, because, as stated, there were no water bottles.
Kids were allowed to play with toy guns back in the day. Even at school or at public events. Toy guns were marketed as looking as close to real guns as possible.

JFK was the last honorable democrat.
Anyway, that’s a harmless toy “cap gun” you had to buy these little orange revolver caps to go inside. Made a nice sound when you hit the trigger.

Could have belonged to a shop owner. Might have thought nothing of loaning it to him, and then taking it and putting it back behind the counter.

Eta. He seems to be speaking into some kind of microphone. You see the cord go down and looks like it wraps around his back but then where does it go? You can't see it running along the ground anywhere at the foot of the stool...

Back in 1970, 5 year old me was always running around wearing my Colt 45 cap guns & gunbelt holster. The lady working the admission booth at the San Antonio Zoo wouldn't let me enter with them though...thought I might scare the animals.

Water gun would be my guess. If it is hot, kids use to suck on water guns. Saw it all the time in the sixties.

Toy gun. Very normal in 1960 for little boys to play with toy guns.
