According to this LINK it wasn't secured, which to me means not attached.

Not secured doesn't neccessarily mean not attached

To me, secured means attached and properly tightened.

So it can be attached, and not properly secured.

And the Cop at Woman's Hospital that showed people how to put in carseats told me that was law.

Right? I mean, it's awful that she lost a child but she's going to have some consequences here. You can't pile 7 people and a baby safely into an Xterra and just hope an accident doesn't happen.

The driver of the other vehicle needs to be arrested and dealt with sternly, but she has some consequences here.

On one hand, you have a guy who was excessively speeding.

On the other hand, you have: 8 people in an SUV made to seat 5 (based on the reports), an unlicensed teenage driver who improperly pulled out in front of the speeding car, and a baby that wasn't properly strapped into a car seat that wasn't secured.

So... a little column A, a little column B.


ETA: And regardless of what comes of it, it's pretty easy for me to see why the mother was charged.

The BRPD is out of control:

How often do you see citations handed out to all of the adult passengers in an accident that wasn't their fault?

Granted, the Xterra was taking a left at a green light and the Corvette had a green light too, but going 94mph in a 50mph zone puts the bulk of the fault on the Corvette driver IMO.

A) She lost her child. Seems pretty consequential.

B) BRPD should have handed it over to the DA's office. They'd take it to a grand jury and let it go from there. You don't go out and arrest the woman in a case like this, then hand it over to the DA.

I'd be willing to bet the seat didn't have the over the top strap buckled down to anything since passengers were in the back of the vehicle. Was that the only part unsecured, I don't know.

I'm glad they are sending a message to all the other clowns riding around with small children crawling all over a vehicle. I saw one a few minutes ago with 5 or 6 crawling around - in the end we all pay for it.

I'm not sure about all of this. Sounds like enough blame to go around.

I do know, I'll be taking my car to the fire station down the stree this weekend to make sure my niece's car seat is properly attached. This shite scares me to death.

Similar story in NBR from a few years ago when the toddler fell into the storm drain that wasn’t properly covered.

BRPD arrested the mom for child endangerment. Mainly to lessen the civil suit that was going to happen to the City.

Agreed. I think this is more about trying to get people to secure their kids in the car than to make their guy look less guilty. They probably don't mind that happening, but more towards, hey people buckle your damn kids correctly.

Yeh, no

As a parent, the fact this lady is being charged will not in any way be a factor in me buckling up my kids better. It wont be thought about at all


And not sure how charging the other people in the wreck, the non drivers, with seat belt violations helps either........

It doesn't help, but the fact that a baby died doesn't absolve the other occupants of their multiple violations.
