He shouldn't have raped her but she should of known getting 3× the legal limit drunk was a bad idea. She does share responsibility for that. Its like leaving your unlocked Benz in NOs shady areas with the keys in it. You should know it's a bad idea. Even when it gets stolen you share some responsibility. Her drinking led to her unconscious state which made her an easy target for this pos.

Besides, getting hammered at a party at Stanford, one of those most prestigious Universities in the world, is not the same as getting hammered alone in the middle the most dangerous part of a city. Her behavior was typical, so why would should a person expect exteme, atypical outcomes?

If you leave your unlocked Benz in NOs shady areas with the keys in it and someone steals it, they're still 100% responsible for the theft. People should be careful because there are sick, terrible people in this world, but when those sick or terrible animals attack, they're the ones who are always 100% at fault.

This one would've been tough as the judge, although I still think 6 months is entirely too light. But when 2 people are literally blackout drunk and don't remember anything that happened, you're basing the entire case and punishment off how the perceived victim felt after they came to. Basically there are no facts that can be proven or disproven as far as conscentuality, other than witnesses seeing a man taking advantage of a passed out female (which is still disgusting and wrong). 6 years would've been more appropriate than 6 months; but locking someone away for decades over a case with almost no hard facts would be irresponsible.
ETA: even if it was conscentual at the beginning, it's still VERY shitty of a man to take advantage of a passed out female. Chivalry isn't entirely dead, take the female somewhere safe if you have to and leave her alone - even if she was trying to get into your pants all night and passed out just before completing her mission.

And? Insurance expects you take reasonable precautions, which is fair, but that doesn't mean the theft, or rape in the case of the OP, is attributable to the victim in some way.
I just cannot comprehend being so cold as to think someone is in some way responsible for someone else being a criminal. That thought process leads to the idea that a victim was asking for it in some way, which is psychotic.
