This whole situation sounds very odd to me. Something tells me that Hayes was the first to produce a gun. I think in turn this made Smith reach back into his vehicle for his gun and this is when he got gunned down. I don't think Smith gets out his vehicle with a gun in hand. He was a professional athlete, he can handle most anyone without a weapon. I think Hayes was obviously very heated (hints chasing him and rear ending Smith) and exited the vehicle ready to beat some arse and realized what he was up against. I think he pulled his gun as Smiths wife was inbetween both trying to calm the situation and Let off the rounds.

I don't understand how some of you think Hayes will walk free. At least I can see it being reduced to manslaughter. Hayes should get life in prison. Hayes was the aggressor by chasing Smiths car.

I will put a lot of money on Hayes being the one who pulled his gun first. I promise you Will Smith did not pull a gun before Hayes.

I think it's insane what we have become with this "unload the magazine" crap. One or two good shots and then stop, unless they are drawn down on you, then you do what it takes to stop them completely, if that means unloading, then so be it.

Safety is the primary focus of class, as is handling, don't get caught up on the bullshite behind unloading on people. Officer friends of mine tell me that too, but I always feel shoot to maim is the way to go, and I will have to see if I am ever put in the scenario where I have to shoot someone. Hopefully not.

They say he mentioned a gun. Never said anything about a gun. I think Hayes pulled a gun and Smith said something about having a gun also.

You promise? Well in that case.

Will Smith didn't need to pull a gun for Hayes to feel threatened. Its already been established that he told Hayes that he DID have a gun. I'm not saying thats enough to shoot the man 8 times (seven in the back), but it certainly can be argued that Smith was the aggressor just based off of what we know for sure, and that aint a whole helluva lot.

Sorry shouldn't have put the promise part in there. It's just my personal belief, I think everyone is entitled to their own opinion on this board. Also, Saint or not I still feel this way. Will Smith definitely didnt handle the original tap as he should have. (Assuming he knew he hit Hayes.)

Like I said, I think he may have been the first to verbally say they had a gun. I think after he saw Hayes pull a gun, he then made a comment about having his own gun.

It's true man. It's absolutely heartbreaking to see his kids and realize that they are forever without their dad because of dumb arse decisions all around. But people in this thread are blinded by the fact that he was a Saint, a demigod to them. He was a man and father that is now dead. This whole thing sucks.
