and shooting someone who is fleeing or moving away from you is no longer "imminent danger" Again rather judged by twelve than carried by six.

if smith said I got a gun and reaches for it is he fleeing or moving away or is someones life in imminent danger during an obviously heated argument?

if someone is commiting a felony and your are a licensed cc holder. you can walk right up behind them and unload in their back. If you were in a store and someone was robbing it at gunpoint, you can pop them in the back of the head and walk. 100%

so you can stop any felony in the act by shooting someone in the back.

Officer, he was selling heroin, so I shot him in the head.

Officer, he was stealing money from the ATM so I shot him in the head.

Officer, he was tampering with a mailbox so I shot him in the back..

Now shooting someone in the back, who has someone else's life in immediate danger, that sir is different. That is a totally different scenario and then yes, shooting in the back or doing whatever to takes to save the victim is justified because a life was in danger. You won't even get hand-cuffs in that scenario.

But that scenario is NOTHING like the scenario I posted. If you get robbed, and the robber flees, you can't shoot him as he flees.

that is a very different situation and would not be justified. at question here is if smith brandished the weapon and or made a threat to retrieve the weapon from his vehicle while in a heated argument 5-10 feet away from hayes.

fire a warning shot, put one into their leg and make them freeze, but to unload ten into them based on the 'threat' of a gun. Naw.

Interesting. I'm sure the phone records from Hayes provider week be out into evidence.

And if Smith was facing him and turned when the gun went off? He was shot multiple times, you don't know which bullet went into the back. Hayes could have opened fire and then Smith turned....

People are focused on the shot in the back like Hayes did it from behind the vehicle, seems like Hayes was on the side when he opened fire. So only way to hit Smith in the back is Smith turning to protect his wife, or maybe when he reached for something.

There needs to be video of this.

nola.com alert on my phone.

Hayes attorney already acknowledged it, and said he still wants to see the cell phone records of both of Hayes' phones as well as the rider that was with him.

I thought the passenger riding w/Hayes made the 911 call? Hayes was busy trying to tail Smith after the hit and run.

Well, Napolean, it is not obvious at al Hayes smashed the Mercedes intentionally

This doesn't matter. In his zeal to catch Smith he recklessly drove too fast and caused the wreck. Now he might as well have done it intentionally because it's going to seem so

Yes, but I am an ardent believer in shoot to maim, not shoot to kill, and my personal philosophy on that subject trumps any training I got in a short class on safety.

Who is this guy? This is getting absurd. If something was on the video that is clear in exonerating Hayes, it wouldn't take a year.

well, good then. But I need a better source than a person who is named for a movie that makes me cry. Lawyers have said the opposite of what you are saying, as have police, and their advice means more to me than yours.
