Now shooting someone in the back, who has someone else's life in immediate danger, that sir is different. That is a totally different scenario and then yes, shooting in the back or doing whatever to takes to save the victim is justified because a life was in danger. You won't even get hand-cuffs in that scenario.
But that scenario is NOTHING like the scenario I posted. If you get robbed, and the robber flees, you can't shoot him as he flees.

And if Smith was facing him and turned when the gun went off? He was shot multiple times, you don't know which bullet went into the back. Hayes could have opened fire and then Smith turned....
People are focused on the shot in the back like Hayes did it from behind the vehicle, seems like Hayes was on the side when he opened fire. So only way to hit Smith in the back is Smith turning to protect his wife, or maybe when he reached for something.
There needs to be video of this.

I thought the passenger riding w/Hayes made the 911 call? Hayes was busy trying to tail Smith after the hit and run.

Yes, but I am an ardent believer in shoot to maim, not shoot to kill, and my personal philosophy on that subject trumps any training I got in a short class on safety.
