Who is the "His" of "His passenger"? Is it Hayes, or Smith? Is the "car" in "gets out of their car." the Hummer or the Mercedes?
He then says "They" approach the Hummer.
I think it's ambiguous but I can see how it can be taken to mean that two men (Smith and a passenger) got out to confront the Hummer.
he clearly said they approached the men in the hummer. him saying that it was a male passenger recognizes the fact that he had just explained that i was 2 men and 2 women in the smith vehicle.

Have they announced what kind of gun it was? There are numerous .45 pistols that hold more than 8 rounds.

Has anyone not noticed that Chads facts were proven wrong again? 
Yesterday Chad said Smith felt threatened because Hayes approached his vehicle screaming and acting like an enraged animal. Welp, Smiths attorney admits that Smith approached the Hummer
This isn’t a huge issue, but it helps Hayes IMHO to possibly establish Smith was the aggressor.

my best guess...the guys are arguing outside the driver door of the silver suv and then the mention of the gun from smith. he starts to turn to his right to reach into his vehicle, hayes pulls his gun and fires the first shot entering "the left lateral chest wall" smith continues his turn to the vehicle to where his back is to hayes and hayes fires off the remaining shots. albeit this happens all in the span of 2-3 seconds. not deliberate pauses inbetween shots.

Wow, i have to waste a post on your stupidity. You do know Smith approaching vehicle does not dismiss the notion of Hayes getting out as well approaching Smith's vehicle. Witness said and Attorney confirmed that Hayes was enraged and yelling and cursing. One of the two got out of the vehicle with a weapon.
I'm done with the post to post bantering, i've said what i've said, you all are selectively objective. You won't assume a and b but a bunch of ya'll love to assume c and d. We have an enraged a-hole that shot at an unarmed and harmless woman and then proceeded to empty 8 shots into the backside of Will Smith.
