I only assume Hayes was out of his car by that point. I dont know if Smith was, yet. But reports are that his door was open, feet on the ground, torso slumped over his front seat
You forgot about his arm over the steering wheel. You should spend some time going over the videos frame by frame, then analyzing the crime scene photos. You can see Will's body in some of the pics.

Post some screen shots lady

In my younger days I've done some dumb things road raging, nothing crazy or costly.
But nowadays, older/wise/ a father...if anything happened and a dude got out of his car coming towards me, call it the pussification of America if you want, but I'm locking my doors and if I can just driving away. As we see here, it's not worth it. This is worst case scenario, and there really is no "best" case scenario so it just isn't logical.
I also don't carry a gun on me or in my car though, only at home. But if I had a gun in my car, I' assuming I'd still do the same exact thing, just because you have a gun doesn't mean you shouldn't do everything you can to avoid a confrontation.
That had nothing to do with the thread's current content, just things that popped into my head.

why is that significant to you?

Smith: get out of here, I have a gun
Hayes: frick that, I got one too
This is what's going to sink Hayes. Smith was trying to get Hayes to leave him alone but Hates being the aggressor wasn't backing down.

Pierre Thomas just wrote on his facebook that he was a witness and it was over a fricking fender bender. Can't link it on my damn phone.

Pierre, here's the solution.
(1) Promote the family unit.
(2) remove these kids from the failing schools. Vouchers are good.
(3) getting an economy here that's not based solely on tourism.
3 may be the toughest, but there's no way that a family can survive here washing dishes or cleaning hotel rooms.

I don't think we agreed for sure that he was a witness (if he is using the term witness literally).

Solid post from Pierre. Damn it just sucks

I dont think pierre actually saw the shooting. But he was on the scene.. he saw his friend dead. That is something tough to live with.

kudos to him for not vilifying like Brees did without the facts. That really is a great, heart felt post.

Police radio audio of Smith murder
ETA:
quote:
On the police scanner audio, an officer is next heard asking colleagues for a description of the suspected shooter.
"I think we got the -- shooter's on the scene," the second officer says. "We've got one gun recovered on scene."
That same officer continues: "Shoring that up, we got two black males in custody ... with a firearm."
ETA:
quote:
Responding officers did not locate any visible weapons other than the gun authorities believe Hayes used to kill Smith and wound Racquel Smith, NOPD spokesman Tyler Gamble has said. All of the shell casings recovered at the scene matched that weapon, Gamble added.
Investigators impounded all three vehicles involved in the chain-reaction crash. Gamble said police were still searching each vehicle for evidence, including the existence of any other weapons. But, he added, the outcome of that search would likely not be made public, for now, to avoid jeopardizing the department's investigation.

Over a fricking fender bender.
Anyone that has defended Hayes or his actions is borderline retarded. You dont get to run up on someone then claim self defense. That's why he's up on second degree right now.

Exactly.
Lots of huge frickin retards in this thread.
I hope they never experience a fender bender like Will Smith did.
Unreal
