Who reported this? As in, Smith knowing that Hayes had a gun when he walked over. A witness said that Smith announced he had a gun first.

IMO.
IMO, if someone tells you they have a gun and reaches for one in a verbal confrontation, you are in imminent danger. To say you arent is completely asinine.

Now, if you threatned first, you cant use self defense. However, you were def in imminent danger

Well it depends on if Smith was reaching for a weapon.

IMO, if someone is acting reckless and says they have a gun then proceeds to reach for something, you would be crazy to not think your life is in danger.

True. The only people who truly know are either dead, or their credibility is questionable because they are interested parties (Hayes and Smith's wife).

Is it clear that the witness identified which person said he had a gun first?

How did he know?

Is it possible Hayes said, "I have a gun", and Will said, " I have one too, and then unloaded on him?

Who said they wanted fight?

So many questions I have.

no one really knows yet. But if he made it known he had a gun and was reaching for it, it changes everything.

Smith: get out of here, I have a gun

Hayes: frick that, I got one too.

I only assume Hayes was out of his car by that point. I dont know if Smith was, yet. But reports are that his door was open, feet on the ground, torso slumped over his front seat

How do you know he wasn't open carrying? He owns a tow company. I'm sure he usually open carries.
