It does matter though. The difference in sentences between 1st and 2nd degree murder are drastic.

I'm sure Hayes and his attorney are focused on making sure he doesn't get a 1st degree charge.

Lets all sit back and look at this.... Had will smith just pulled over and called police when he rear ended hayes and not hit and run, he would still be alive right now

It'll be interesting to hear, if we ever do, what the passenger in Hayes' car says, what Smith's wife says and what the people in the Impala say.

Lots of assumptions in this thread and very little in the way of facts other than Hayes shot and killed Smith and shot multiple times. Some of what folks consider facts may be disputed by witnesses on the scene who we haven't heard from. I don't think this case is black and white and certainly not on the charge.

H2 passenger confirms Hayes story

Smith wife and friends in Impala sides with will


Other cars and pedestrians w no dog in the fight and the presence of a possible firearm in smiths car will be most important

I don't understand how people can't let that come out before being so vindictive

Can u please stop denying Smith hit him. Watch the video again paying specific attention to the Hummer. It is without a doubt obvious the Hummer gets bumped forward after stopping.
