That doesn't really mean much right now, to be honest
It does matter though. The difference in sentences between 1st and 2nd degree murder are drastic.
I'm sure Hayes and his attorney are focused on making sure he doesn't get a 1st degree charge.

Let's not lose sight of this. If somebody hits me and runs off, I'm not going cowboy. I have insurance for that. I'm not going to chase them down, smash into their car, gun them down in their car, and then claim self defense.

Hayes should have sat down in his vehicle at that point. Cops were on the way

And had you called 911 non emergency that night due to a hit and run, you would still be waiting on NOPD to arrive.

and when he arrived on next scene crashing into will, witness said he was freaking out and declared "We wanna fight you".

I wonder if Hayes hit the brakes to collect insurance money. He saw that expensive car behind him and likely saw dollar signs.

Hey how about you don’t rear-end someone and then speed off, and you won’t get murked out on the streets.
You think Smith ever listened to rap music that glorified this #KeepingItReal mentality? Looks to me like this is just another day in the thug culture they glorify and constructively condone.

Lets all sit back and look at this.... Had will smith just pulled over and called police when he rear ended hayes and not hit and run, he would still be alive right now

Premeditation is not the difference between 1st and 2nd degree in LA. You people need to stop talking out of your asses like you're Perry Mason.
For the purposes of this discussion, 1st degree murder in Louisiana is killing someone with "specific intent" while committing a felony.

Which is why people think he may have been drunk.

He does have a specific history of obtaining settlement monies.

Hit the brakes or come to a normal stop? Someone should make a gif of him "hitting the brakes"
If the guy was trying to scam someone don't you think he would slam on the brakes with hopes of really fricking up his H2?

And a history of stopping at red lights.

none of this would have happened had he actually stopped at the red light.

It'll be interesting to hear, if we ever do, what the passenger in Hayes' car says, what Smith's wife says and what the people in the Impala say.
Lots of assumptions in this thread and very little in the way of facts other than Hayes shot and killed Smith and shot multiple times. Some of what folks consider facts may be disputed by witnesses on the scene who we haven't heard from. I don't think this case is black and white and certainly not on the charge.

I would say
H2 passenger confirms Hayes story
Smith wife and friends in Impala sides with will
Other cars and pedestrians w no dog in the fight and the presence of a possible firearm in smiths car will be most important
I don't understand how people can't let that come out before being so vindictive

Can u please stop denying Smith hit him. Watch the video again paying specific attention to the Hummer. It is without a doubt obvious the Hummer gets bumped forward after stopping.
