Absolutely. I'm just saying I could understand how Smith found that to be intentional (if there was no obstruction causing Hayes to stop that early) and went around him because of it and also considering the light tap. If this was his mindset, I'm highly betting on some liquid courage helped him make that decision.

Crazy thinking that if he simply stops there this may have never happened. Or maybe it still would have, who knows.

He could have been reaching for a cell phone, insurance card, dildo who knows. You can't shoot someone unless you actually see a gun. Regardless if he thought smith was going for a gun he had an opportunity to retreat. He didn't retreat. He followed him to the car and shot him in the back.
,
Regardless his money will be gone after fighting off these criminal charges and then the civil suit that will come after. He will be broke before this is all said and done. If not in jail for 20 to life.

Hey Chad
What happened to you letting us know the fact that smith didn't rear end him?

I think there is a 2nd gun also. That lawyer is to smart to allude to that, and it not be true.

My question is, why is the nopd not releasing that info? Theyre deliberately saying only one gun was confiscated.

I have to ask I'm curious as to your motives in this whole thing. From the very second this happened you were all over Hayes not having culpability and questioning Smith being the victim. What's the deal? Just curious.

To be fair, I think a lot of people have been this way. Very early on there were reports that the shooter called 911 and there may have been a second(first?) wreck and that the shooter stayed and did not attempt to flee. This is not your typical nola murder. There are reasons to be skeptical

Maybe Smith just said he had a gun and didn't really have one.

I understand that and that may ultimately be what happens, but it's just strange right now.

Most people well versed in the law would say yes

I feel like if someone says "I've got a gun" and then turns around to rummage around in their car immediately after saying that, it's an absurd standard to say the other person must see a weapon before "defending" himself.

It's completely reasonable to believe someone is about to draw on you if they say "I've got a gun " and immediately start digging around an area that one would reasonably assume contains said gun.
