If it wasn't, I would certainly try to argue that Stand your Ground doesn't apply because of the "unlawful act" provision in the statute.

However, I'll readily admit I don't know the case law on it. Stand your Ground has only been in place for 10 years in La though.

Has the lawyer asked for Smith's brain to be examined for CTE yet?

I haven't followed this case very close but could see the defense arguing that Smith was enraged due to CTE.

i seriously doubt it, he has a prior recent weapon charge and a drug charge. I bet he actually cant even legally own a fire arm at this point in his life.

there have been some assertions that if it wasnt legal hed already have a weapons charge here.

in his last arrest he eventually pleaded out to "a reduced weapons charge" and just a paraphernalia charge

theres a chance it was legal, though im skeptical too.

he pleaded guilty to a misdemeanor not a felony so from what I know he could legally own a gun unless it was part of his plea agreement from the prior arrest.

So which is it? Hayes was going nuts with his shirt off and wouldn't leave Smith alone? Or did smith tell him to "get out the car, I have a gun"?

Maybe it was legal maybe it wasn't . This will be unpopular but if the facts come out that the shooting was justified I have no problem with him attempting to preserve his own life
