Agree.
You can't run outside your house firing off rounds in the middle of the street b/c your raggedy truck got broken into.

What about a raggedy vette?

And you certainly can't shoot at three people, which is what happened. I simply cannot believe that, as Fontenot's defense argued, he was firing randomly and just happened to hit all three kids.

I get he was pissed off. Evidently, he had problems before.
That said, I get pissed off every time I drive in BR. I don't reach down and pop off a few .45 rounds at every numbnuts I see. Plus, I only have 3 magazines.

How did the defense get to pick the judge?
As an aside, I thought manslaughter required 85% time served Bc violent crime?

Except nobody was stealing anything from Fontenot that night. They were dropping Austin off at his house.
pardon me for just joining, but are you saying that at no point was the truck Austin was in stopped near Fontenot's house?
Did he literally walk outside for no reason and start shooting at the first random car he saw driving by for absolutely no reason, no matter how dumb his reasoning may have been?
What was his reasoning for shooting at that particular truck? Did he see them stopped by his house?

1st Degree conviction is eligible for Capital Punishment and requires a unanimous verdict in both the trial and penalty phases. If a verdict of Death isn't reached in the penalty phase, Life w/ no parole is the default.
1st degree wasn't a possibility based on the known facts.
I wasn't in the trial so I can't argue that manslaughter was inappropriate responsive verdict.

Well, it sounds like he was charged with 1st Degree, so maybe the DA knew something that you didn't.

for some reason people seem to believe seth's side of this story that they were stealing from him. He only has the possibility of life in jail as an incentive to lie. While the kids face attempted robbery while they're still underaged?
but i guess we're supposed to trust the inherent truthfulness of drug dealers and murderers

Keep in mind this was not a defense of property. No crime was being committed when this guy ran outside and shot at three boys driving down the street.
Was not referring to this case in general, just stating that the punishment no on longer fits the crime and people literally get away with murder because of it.
In his case specifically, he would have been punished more severely if he would have had marijuana in his possession, which is mind boggling. Lucky for him, he only killed someone riding in a vehicle that was slowly approaching the residents of where the deceased had currently lived.

There's a lot of biased people on the side of the kids in this thread. Look at it objectively and not personally.
These dumbass DA's keep going for murder 1 on cases to appease the public and come back with little or nothing. See George Zimmerman, etc.
I think the guy deserves more than 3 months, but going for the max when he didn't do the crime to deserve it is dumb.

People are defending the kids because they got shot at without any proof they were doing anything wrong! AND, they were a threat to NOBODY, nor were they on Fontenot's property. Does he deserve capital punishment? No. But he shot and killed a kid with no evidence that he did anything to his property, and who was 50 feet away from his driveway.

zimmerman was in florida. In LA you can convict of a lesser crime (manslaughter or murder 2) when charged with murder 1

This is a dumb sentence and you should feel bad for writing it. The "dumbass DA" got a conviction for manslaughter, which can carry a 40 year sentence. They charged first degree murder because the statute, 14:30, allows for it "(3) When the offender has a specific intent to kill or to inflict great bodily harm upon more than one person." You can blame the judge but not the DA.

quote:Applying this logic, if someone kills Fontenot, then the next judge should go easier on the killer since Fontenot is even less of an angel than the kids he shot.
Maybe the judge didn't buy that the three kids were angels that were just driving down the road minding their own business

I don't think people are buying his story. People just find it hard to believe that he would run out of his house and randomly shoot at a truck with 3 kids in it just because. The truth is likely somewhere in between both stories.

The statement was merely me speculating the judge may have thought the kids were breaking into his truck which is why he gave a light sentence. Not about the prior behavior of each of the kids collective time on earth. I don't know anyone involved they may all be great people.
