That’s a decent settlement. Afterall, her freedoms and liberties were taken away, if only for a relatively short period. Additionally, her arrest, if you want to call it that, was plastered all over the United States.

IDK the cop wrestled her out of the ER with the policy in her hand showing she was correct and put an arm bar on her as he cuffed her. All this is at her work while she's on the phone with an hospital administrator saying she was within policy.
I hope the cop is working private security and talking about the "good ole' days"

I wonder about that though. I mean the chances of her getting a settlement were extremely high. It's not like an accident case where the lawyer doesn't know if he is going to get paid or not. Seems like she could've had her choosing of lawyers and even jewed them down to whatever percentage she thought was fair. I mean, if I'm a lawyer (lol) I'd be okay with taking that case for like 30k because of the almost guarantee I'm getting paid.

$500K seems a bit high when you consider the damages: some rough treatment and a ride in the back of a police car. No real physical injuries, just psychological. Prolly worth about $25K.
Then again, I'm a stingy defense lawyer, not worried about months of bad publicity for the force.

The police need to be fined or fired for something like that but why does the woman deserve half a million dollars? I don't think "deserve" means what you think it means. She was wrongfully assaulted and detained. Does that equal enough money for someone to almost retire on?

Half a million for the illegal racket they were trying to run to avoid paying the since deceased victim that they killed in a hide speed chase. Should have been 5 million.

This type of "above the law" BS they were trying to run is far more damaging to liberty and freedom in society than the nurse being arrested. They didn't pay enough.

I agree about the deserve part of your argument. A majority of the settlement would be based on possible punitive damages, which is the civil analog to jail time in a criminal case.
I didn't look into punitive damages in Utah other than a cursory glance but it appears making an argument for punitives is fairly easy (some states have fairly high bars to clear to make the argument and has to be argued to the judge pretrial). The interesting thing about Utah law is that a portion of punitive damages reverts to the state's General Fund.

so you're thinking of punitive damages. My LA mindset references compensatory damages, which makes this number very high. Not sure if Nevada has punitive damages for this type of tort. If so, you may be right, but making the insurer for the police force pay it vs the actual guilty officer and his supervisor doesn't really provide any motivation to deter the behavior, which is the goal of punitives.
