Used to they'd get a warning from their processing company mandated by the card brand (VS, MC, DS or AX). If they continued the practice, they would get blacklisted from accepting credit cards ever again. Anymore I believe the card brands have gotten looser with surcharging to the client. There is a cap to what is allowed now if I understand correctly. Some businesses sorta got around the rule with a "cash discount" which is essentially the same thing but legal in the processing agreement. AmEx has gained acceptance in a lot of places because they've started falling more in line with Visa and MC's pricing but they're still more expensive. Just not exponentially more expensive.
I used to be a pricing analyst at a credit card company. Interchange expense at a restaurant for a rewards card is all in around 2.04% plus $.20. It gets surcharged past that by some amount to the actual business. So maybe 2.5% or so is a common rate to pay for a rewards card. It is a real expense to the business but like said previously, it should be built into the meal prices. Not line item'd out.
I'm friends with a GM at a local chain restaurant and he said his run-rate is around 1.75% give or take .25% each month. I imagine that is common.

Stop at a little boudin place in patterson along US90 a few weeks ago and the lady gave me a 3% discount because I paid with cash. So they have it already figured into their price.

You sure about that? Because I dont remember the bill changing after I give my credit card. You saying they charge you for the CC fee even if you pay cash?

I went to a place recently with a $5 minimum for CC purchases. I got what I wanted and it was $3.40. Then I realized the sign. I grabbed a canned drink that was $1.25 and it came up just a few cents short of $5.
I told the girl just to charge my card $5 and she acted like I grew a nose out of my ear.

It is only illegal if there is a state law against it--meaning there is no federal law against it (BTW, as far as I know, the only federal law on the subject is that a merchant must accept legal tender, which is money printed or coined by the US mint).

So they just charge it to everyone regardless of payment. This isn't that hard to understand, but you have people like the OP bitching so the restaurants just bake it in for everyone.

The waiter can easily avoid this by saying they charge a fee when they seat you. "We charge a fee for cc but we have a ATM right over there if you would like to use cash." How difficult is that?

Guy by our house has decent popular restaurant. Does't accept credit cards, but has an ATM onsite, and also accepts checks.
Same guy opens a second restaurant. Accepts credit cards. However, charges a 2.75% fee to do so. It's listed seperately on bill. That information is in very small print on the bottom of one side of the menu.
Just seems very petty to me.
I run a concession stand for a youth facility, and we accept credit cards, and don't charge a fee. And that restaurant is making much more money than we are.
