It will be very interest to see how the jury interprets the Citizen's arrest statute. I'm sure the Court will instruct them to read it a certain way and the prosecution will explain it in great detail, but here's an excerpt from an older case in GA:
That AND is important. I've seen it argued that the whole "in the presence of" part doesn't apply to suspected felonies. Well if the court instructs the jury that way, it's tough to see an out for the McMichaels. Their whole defense hinges on them being able to legally effect a citizens arrest. We know for a fact that the trespass did not occur in their presence. If they had to witness a felony, and not just have probable and reasonable suspicion that a felony occurred (already a pretty high bar) then they have little chance.
