Yeah.. this isn't how it works. The contractor has to be low on bid day; these are public bid projects. The only thing they can try and cheat is the DBE involvement goal, which pretty much every contractor down there does.

With that being said, the A/E's (Architects and Engineers) do not have to follow public bid law. A/E's are professional services and are procured under RFP's, which are graded and then pretty much hand picked by the city council.

So you tell me where the problem lies.

My opinion is that it's probably a shitty contractor with terrible oversight from an equally shitty engineer.

This. This should've been caught by the engineer and his inspector a long time ago. But at the end of the day it's still the contractor's fault

But everyone crying corruption is just wrong. The contractor was the low bid and he now has to redo it at no cost to the owner. Depending on the size of the project, shite like this is why a lot of contractors go bankrupt.
