Question for lawyers: Would signing a waiver make a difference in regards to sports?

I guess it would have to be signed by parents as high school students are too young to sign.

What I am getting at is schools, organizations probably are nervous about having complete liability.

Would waivers help in that regard?

I have to sign a waiver for my kids in catholic school in NOLA just to attend class

Waivers in advance of a negligent act are null in Louisiana.

But who would you sue and how would you prove it? Covid cases are losers IMO.

also you cant sign a waiver for everyone else you infect while spreading it

I’ve always been told signed waivers mean nothing until something is signed after the incident. I’m not a lawyer, just heard that from a family member that works in insurance.

Lol...I’m this fricking state?! You could sign a million documents and video yourself saying you don’t hold anyone accountable and the legal system in the dumb fricking state would still award damages.

I think you can waive damages for your own negligence, but waivers for someone else’s negligence are null.

So, it’s a useless document. Indemnity agreements are where it’s at, sometimes.

How could I waive damages for my own negligence? Am I going to sue myself?

You can waive economic damages not personal injury liability.

If you go to a skate rink and sign a waiver that waives their liability for personal and property damage and then one of their employees negligently breaks your leg while another leaves your locker open and your wallet gets stolen, you will be able to recover for the broke leg but not for the stolen wallet.

Could they not argue that failure to social distance/wash hands/etc., or choosing to attend if you have underlying health issues, is your own negligence?

Not a lawyer, but I don’t understand how a business can be liable for a customer catching a virus from another customer in the first place, assuming they are operating in compliance with all applicable regulations. I can understand how an employee might have a case, but a customer?

Feels like the equivalent of a freshman catching the herp and then filing a lawsuit against Reggie’s. But maybe I’m oversimplifying it.

It’s really sad that people like you want kids to return to “sports” and spread the virus when people of size that can’t play sports are who’s dying from the virus

Maybe if you tried not perpetuating thin culture just once we’d all be better off as a planet?
