I have looked this up because I wasn't sure. But step parents have zero rights unless you actually adopted the child. I'm assuming he didn't because he thought she was actually his.

So I don't think a judge can rule anything in favor for this guy.

Looking into it a little more, I think 23 states have some step parent visitation rights, but it still comes down to best interest of the child.

i've been in that dudes shoes. not in a paternity sense or a court sense or a cheating sense. dated a girl with a kid. went off and on with the mom for 2-3 years. helped raise the kid and eventually he was confused that i was his dad. i eventually had to cut ties to the mom which meant i had to cut ties to the kid as well. that feeling sucks because in a sense, i was ready to take on the "dad" responsibility. it just wasn't working out with the mom.

His name should be on the birth certificate since they were apparently married at the time. That wouldn't make a difference?

I see the girl's point. If I was her I'd be ashamed to have slept with him and wouldn't want half of her daughter's genes to come from an obvious beta.

Now the cheering was a little much but maybe it was played up for t.v.

I had something similar happen to a college friend of mine and I still personally hate his ex wife for what she put him through and how she used “her” child as a weapon to hurt him. It has been 12 years since it happened and I don’t know if I’ll ever forgive her for what I had to witness a close friend go through.

This isn't necessarily true in some states, and there is also a time frame in others where you can challenge it.

States are increasingly giving more rights to the man as this kind of thing becomes more common.

They never got married. The OP was mistaken to call him the ex husband. He's the ex fiance. That part is mentioned during the full episode I linked.

How on earth did more that one guy have sex with that thing?

Anyway, really tough choice for this guy now. Try to stay in the little girl’s life or run like hell knowing he has no legal responsibility.

I believe the false paternity rate is about 5% or so. That means there's a lot of dudes out there raising kids that aren't theirs. DNA testing has just brought it to light, but it's always went on.
