From what I understand assault is the threat to hurt someone. Battery is. The actual hurting someone.

Alt26 has it analyzed correctly. A person who reasonably believed he was about to get run over by a bus would have scampered out of the way. Wouldn't you? I suspect no criminal charges will be filed unless it's something like careless operation of a motor vehicle. But, that obviously does not mean that the bus driver isn't a jerk.
