First, did the place you were staying do something that caused the swing to flip? I mean, if you were sitting in a way that would have increased your chances to fall then that is on you.
Do you have insurance? What is the reason you want to sue them for?

If you want to press the issue, you can probably threaten to sue and get $10K from their insurance that will be split between you and your attorney.
I personally wouldn't consult a lawyer, since I don't see where the property owner did anything intentional or grossly negligent and I am not the kind of person who is opportunistic in that way.

No you shouldn't seek an attorney. You sat in a swing that fell. shite happens. It didn't injure your back, may have exacerbated the issue but you said yourself you had injections. I'm assuming you have insurance. You don't need this guy paying for your pain and suffering because a bolt backed out on a porch swing. And someone with such chronic pain should probably be making double damn sure of where they put their arse to avoid further injury. Most porch swings are not what I'd call orthopedic.

Yea, I don't think you should be sitting in a hard bench swing with existing back injury. Accidents happen, suck it up and go on.

You're acting like the homeowner did something wrong. Do you really think the homeowner neglected the swing and that why the bolt fell out? Sounds a lot like it was just a freak accident. Why do you want to sue the owner? What did the owner do negligently or otherwise to deserve being sued? The swing fell sure, but why? What day did the swing fall? If it wasn't the first day, your family could of easily been the cause of it.

I'll say this. I never sit on swings like that. Those screw in bolts are fricking garbage and will fail eventually.
The porch swing at my buddy's camp we beefed up the rafter and had one guy in the attic to put multiple washers as I drilled all the way through it for a long arse eyebolt.

Eh, the owners negligence is there, however i wouldn't say it is "grossly negligent". Sue his insurance company, they'll settle, most likely, depending on what you are asking for. Price of vacation, plus money potentially earned at work, plus bills.
