We have insurance . I have to pay to drive it home. Its like 120 bucks a month.

is it worth it to gamble? personally i pay any sub $1k claim out of my pocket because my insurance is ridiculously low and i want to keep it that way.

eta my kid sideswiped another car literally a month after getting his license. he called me from the parking lot with the guy he hit after they both pulled over and i drove over there and negotiated with the guy (he went to Maaco for an estimate) and just had him sign a piece of paper in front of a notary that said we were free & clear and I gave him cash for the amount of the maaco quote.

Need to look at La. R.S. 23 §635. Assessment of fines against employees unlawful; exceptions

No person, acting either for himself or as agent or otherwise, shall assess any fines against his employees or deduct any sum as fines from their wages. This Section shall not apply in cases where the employees wilfully or negligently damage goods or works, or in cases where the employees wilfully or negligently damage or break the property of the employer, or in cases where the employee is convicted or has pled guilty to the crime of theft of employer funds, but in such cases the fines shall not exceed the actual damage done.

A pay deduction as described by you is a fine.

Depending on your job, there may be some FLSA issues.

1. Your boss sounds like a real jerkoff.

2. Did he get something in writing from her signifying settlement when he wrote her that check? If not he is a dumbass and may have initiated a coverage issue with the insurer down the road when both of you get sued.

I could’ve, but that’s happened to me in the past and I’m not an arsehole. She was so nice to me, thanking me for not driving off, knowing she just got her a nice payday.

Why should the lady be forced to accept your workmanship in fixing her car? She doesn’t know you from Adam. You also have a vested interest in getting it done for as cheaply as possible. Why shouldn’t she be able to get an estimate from a shop of her choosing?

This is the first thing I thought of as well. Seems pretty cut and dry yo me, but I’m not an attorney.

unless she works for the body shop, exactly what kind of payday did she get here? the hassle of having to drop her car of and get it fixed hopefully as good as it was before?

Ok now this is really messed up if you’re paying $120 per month for insurance your boss apparently doesn’t want you to use.

Legally I don’t think you have any rights at this point other than to look for a job that doesn’t dick you around.

Oh and just be glad the lady didn’t show back up in a neck brace with a mysterious migraine.
