Why would you want to do this?

If you have to post a thread that starts "ot lawyers" just go talk to a real lawyer.
Personal injury lawyers don't charge for consultations.

Because there is not a damn thing wrong with the car. The entire amount of damage is cosmetic. The car is paid off and I refuse to buy a new damn car and start that process over again.

But if OP doesn't have the "injury" part the lawyer will tell him to pound sand.

You are obviously smarter than the adjuster, why don't you offer to do his job for him.
You've never been accused of being smart or wise, have you?

This. You got paid, what's the problem? LA law says when a vehicle hits 75% of its n.a.d.a. value in damages, the insurance company has to total it. They don't have a choice. They WOULD have paid you N.A.D.A value, PLUS tax, title and license if yoy hadn't kept the salvage.

If the vehicle is worth 7700, that's what it's worth. How is that bull shite? Cars depreciate in value quick man it's just the way it is.

Well, considering that FB has a guy who is going to fix the car for $3,000 less than the original quote was, it sure seems like everything he did was highballed to ensure this being the case. Seems to me their concern is money over the people who pay into it all those years.

Doesn't sound to me like it is in very good shape.

Insurance Companies are in business to
a) protect you
b) make money
Rank these two answers in the order of importance to an insurance concern
I'll hang up and listen
(Hint: b-1, a-2)

Why isn't State Farm paying? Are you in Mississippi, or Louisiana?
In LA once the repairs exceed 75% of the ACV of the car you have to handle as a total loss.

This is correct.

I am the one who is calling State Farm at this point. When I told FB no to the check they offered me, they basically stopped helping me and ended any guidance. I am the one working with SF and calling the girl's agent. I just wished after all these years they would be willing to work.

Why didn't you call State Farm from the start was more of what I was asking. And once you settled the total loss, SF probably won't pay your rental either.
Also, it doesn't matter what the damage is, structural vs cosmetic, it's the amount of damage relative to the value of the car that totals the car.

Then go without it.
I'm not complaining that Insurance Companies are out to make money, that's reality. The OP doesn't seem to realize it.

My agent said he was taking care of it and said it took time. I trusted him and didn't know what questions to ask in the very beginning waiting on the quote.

If it was structural, I would have accepted the buyout. However, with the damage being 100% cosmetic (side doors, headlights, mirrors, dent, etc.), it has become too much for me to accept not to fix it. The mechanic who is working on it is very highly regarded and has a strong reputation. I work with his wife at the school I teach at and know he won't do me wrong.
I decided to go this route when I saw the exact same car and near identical mileage was going for almost $2,500 more. Just too frustrating to accept.

LOLd at wisenheimer, haven't heard that in years. True, making money is the end game of literally every business in existence.

Could OP still bring this claim after he settled with the insurance company?
As long as he didn't settle the B/I portion. PD is separate from B/I. You settle and get your vehicle repaired, and your injury claim is completely separate from that.
But it sounds like he is dealing with his own insurance on the PD part, and they don't have to keep paying his rental once they total the car and pay him. But he can go against the other party's liability insurance for that, and get paid when he settles it all out.
