Although I have no idea what Mississippi's mechanic lien law says, I would have to believe that the shop f*cked up in not checking on whether the bike was stolen BEFORE they put any work into the bike. Had they done any due diligence, they would have discovered that the bike was stolen and they could have reported it to the police and turned the bike over before they worked on it.

Hard to argue that when they've already given him a bill and indicated that the bike was good to go.

The OP was wise enough to get pics of the condition of the bike. There is a record of what the current state of the motorcycle supposedly is.
I was hoping to have it seized before the "cease and desist" letter showed up but I don't think that's possible unless the mail is slow and it is picked up this morning.

Just got off the phone with the investigator working the case. The next thing on his list today is to have the bike officially seized and kept by the police.
I told him that I was scared that the bike would either be stripped or missing. He laughed and said "if anything is missing it's ok, I enjoy throwing people in jail".
I'm expecting a text before the day is out that it's in the possession of Law enforcement.

I’ve been following this thread and if the cops do what they said they are it’s going to be wonderful news.

It's pretty amazing how quickly people cave in this world to bullies like that - they've probably done similar shite in the past.
Takes one good fight to end it all for them though.

I think at this point I have all the details that I'm going to have about the situation. I'm pretty sure I know most of the story on how all of this played out. I spoke to the OP and we discussed it this afternoon. I'll update the whole story here once I'm in possession of the motorcycle.
The motorcycle is still in the possession of the shop but the investigator has been assured by the shop owner that it will be fine and nothing will happen to it.
The seizure process is moving forward and apparently in Mississippi requires a court order by a judge in cases like this (@BruceJender I did read the law and it is legit). If it would have been discovered stolen as part of a stop or search warrant it would have been seized immediately. These conditions are different.
At the end of the day, the shop that has it gets nothing, Zilch, nada. According to the investigator, this was explained to all parties today. The OP is in no way on the hook for any charges whatsoever. They actually had a chance to get the storage fees. In my opinion they waived that when they illegally tried to extort the cost of repairs and started the abandonment process attempting to take possession of the motorcycle.
I asked the investigator if they could have it seized by Friday. He said "we'll try". It doesn't matter, I'm going north on Friday morning with an empty trailer and I'm coming back south with a motorcycle.

It’s not likely that they rent them in the town the bike is located. Even if they do, I’m not taking any chances. I’ll pick one up the night before and leave early to go get it.
I want as much time there as possible if I have to unravel something when I’m there.
