I argued with a prosecutor after getting a ticket for drinking a beer at a gas station. My contention that the gas station was private property, and that the drunk in public statute didn't apply. He dropped the charges

I asked for a go-cup in York Pa last month and i thought they were going to call the po-po on me. Bartender called the manager over for him to explain the law. Asked for a spit cup after that and it was also no bueno.

2 examples of New Orleanians used to go-cups getting around the law in other places:

1. In Seattle, wife and I had just finished eating a nice dinner; she wanted an Irish Coffee to take with her as we drove along the shoreline afterwards at sunset. We ordered one, they brought it to our table (in a big fru-fru glass) and we paid the bill. She went out to the car, and I took the coffee with me to the bar and asked for a Styrofoam cup so I could take "my coffee" with me. They gave me one, and I poured the Irish coffee in the Styrofoam cup. But then the barmaid caught me:

"Hey, wait, is that an IRISH Coffee?"

"Ummm... NO!"

And then I dashed out the door before they could stop me.


2. In Vancouver walking along the waterfront, on the way back to our hotel, wife wants a cocktail to drink as we walk. Wife sat on a park bench while I went into Starbucks, got a cheap medium coffee with a lid. Went into their bathroom and poured it out and rinsed cup. Put cup/lid in my jacket pocket.

Then went next door to a bar, bought a cocktail (served in a glass). Sat a bar for a minute and had a few small sips, then took it with me to bathroom. Poured it in the empty Starbucks cup, covered it with the lid, walked out fake "sipping my coffee". Wife got to consume her cocktail in a go-cup, and I got props for ingenuity.

People throw them out so there is no evidence in case they get stopped.

My northeast open container story:

Me and some baws went to Boston/cape cod to watch some baseball and for a game in Chatham, we set up in the outfield to heckle Jon Zeringue. We had an ice chest of beer and were just having a good time. Cop rolls up and asks us “are you guys stupid or something, you can’t drink that out here!” We apologize and explain that we didn’t know and we were from Louisiana. He laughed and said “oh, got it” and made us pour our beer out and put the ice chest in our car.

Several of the municipalities around here have gone the route of designated entertainment districts to get around this. Basically any group of bars and restaurants within walking distance of each other can get it voted on and if it passes you can leave establishments with your alcohol and stroll around in this area. You can’t get in your car with it but it has been great for the areas.

My wife and her friend ordered some Long Islands and the waiter wouldn’t bring us to-go cups. So i ordered 2 water to-go. Poured them in the glades on the table then poured the Long Islands in the to-go cups.

Went to an Alabama LSU game and when we walked out the bar i saw i stack of cups by the door so i grabbed one, put my beer in it and started to walk out


the bouncer tackled me like i just shot JFK. I was so confused. He was like "bro cops LOVE writing open container tickets, especially to LSU fans" i asked what the cups were for and got no answer

Not correct but also not likely to get you in trouble unless they are looking for any reason to jack you up.

If it is in the passenger compartment of your vehicle, you can be charged. Whether you will or not is up to the officer.
