I thought the diversion program essentially put you on DUI probation. If you do not get another DUI for a certain # of years, the DUI is removed/scrubbed. If you do get another DUI in that time frame, then the original DUI is reinstated.

They were supposed to start fixing it, and adding several pull-off spots. All I've seen done lately is jack-up barges floating around in various spots. I don't drive it every day, but I haven't seen any actual work on the planned safety improvements.
IIRC, it was all supposed to be done by the end of next year. Just like every Louisiana construction project, that's not happening

Want me to elaborate? Didnt think it would do any good considering your response - seemed like you had it all figured out
Most pretrial diversion programs in this state allow you to complete certain conditions and pay a hefty fine to that parishes district attorney/prosecuting authority in exchange for a complete dismissal of your charge. It doesn't "scrub it from your record" - the arrest would still appear on your rap sheet until you got it expunged, but the arrest would not have resulted in a conviction. A predicate conviction is required to be "tried as a second."

The conditions vary depending on the parish. Most would require you to avoid all criminal conduct not just getting more duis. And yeah if you were to catch a new charge you would probably be kicked out of the program and would have to fight the original charge.

Not if you're already convicted but in most jurisdictions you don't even need to go through diversion for a hired lawyer to get you a plea to 1st offense. There are thousands of people on Louisiana highways right now with multiple 1st off DWIs.

Well I think it's excessive.
Sentences for these type of crimes vary widely, often based on the enthusiasm of the victims family (which often becomes muted if the perp can pay a big tort claim).
But beyond that, it's just excessive.
And on a side note, we should use technology a lot more in stopping DUI.
