“The cash wage policy is the direct cause, or at least a motivating cause, of this disparate impact,” the complaint said.
I cannot stand language like this. The first sentence places all blame on the cash wage policy, affirming it is THE cause of some employees receiving lower tips. Then, the very next sentence says well, it could be a motivator of the problem, suggesting that, no, it isn't the sole cause as suggested in the prior sentence.
Textbook misleading quotes and/or language. Just say one or the other. It is either THE cause or A cause. It cannot be both.

Yes, but you can get never-ending terrible food with no redeeming qualities.

It won't here in the short term. Good servers get rewarded, shitty ones flame out because they don't make much. Good servers will find other avenues either slack off or find other opportunities to make the money they were making before. Shitty ones will remain since their paycheck is now guaranteed. It will take time for that to no longer be the case. I'm cool with keeping it the way it is now, and most servers probably agree.
It's Olive Garden... if they were any good at waiting on tables (and making good tips because of it) they would quickly catch on at a higher-end restaurant.

So it has nothing to do with the location of the restaurants they work at?

Tipping culture needs to end.

Tipping is directly related to how good the service is and how good looking the waiter/waitress is
You have them in the wrong order as far as importance, but otherwise this is correct.

The concept of tipping wait staff is one that needs to end, especially in places like Olive Garden.
Here is what the wait staff is doing:
1) Take your order
2) Refill drinks
3) Sometimes bring your food out (although more and more, it seems like this happens by a food runner, not your waiter)
4) Bring your bill, collect and process payment (which Olive Garden has those tabletop machines now).
The actual most important part of your dining experience - the food - they have really nothing to do with.
I understand in higher end restaurants, the wait staff can do more to improve your experience. But in places like Olive Garden? Come on.
Pay the OG employees a decent wage so they don't have to live on tips, and this problem goes away.
(And for those who think service will degrade? OK, fire those employees).

Because that would be racist.
Hate to be the one to break it to you, but your comment is racist. Of course my comment was racist as well. Just as every comment on TD, and everywhere else.
This is my developing theory, of course. So far though it's proven true, almost factual...
Dangit! Proof and fact. Both racist. Where does it end?

Oh im with you, other than most servers agree. most servers where i live are liberals, so they want higher minimum wage and still want their tips.
I would be glad to exchange the higher wage and I just wont tip because it will already be in the food and drink prices.

Yeah we had this when i used to work events. that way when the hard workers sell more we get screwed by the ones stealing and not keeping track of their inventory and cash collection. The good workers quit those jobs and find another where they wont get shafted by shite co workers.
