When it comes out the kid stole his dad's loaded gun out of the closet, throw him in jail.

The important word here is stole. Obviously the kid had something wrong with him if he brought the gun to school and used it either to harm himself or others. Maybe his Dad should have picked up on something being wrong but it doesn't make him a criminal for having a firearm in his home. And it is way too early to speculate how this happened.

What if it comes out that the gun was NOT loaded and a 7th grader happened to not be an idiot and knew how to load a gun? What if it was in a safe, but the boy hunts with his dad and knew the combination?

So, this is an attempted suicide that the libs will label as the 19th or 20th "school shooting". Using semantics to further a gun control agenda is wrong.
