The guy with the bat held up as the guy put his hands up. Then he swung at his window for whatever reason and the other guy got his gun and unloaded on him. I think going after him when the guy was retreating was way too much. Especially all of those extra kill shots. And especially considering he did hold up from actually hitting the guy. I understand we don't know his intentions, but I would find the shooter guilty. That was horrible.

Well tactically, inside of the vehicle is the worst place to be IF the other guy has a gun and is out of his car. He can move and you can't and he will kill you. What you do is let him get out, and then drive away. If you commit to the fight you have to get out first and shoot first. Then you will win, and you will also get murder charges and life in jail. If you stay in the car and he doesn't have a gun you're safe. But this guy didn't have any of that information.

If I were in the shooters situation, I'd like to think I'd have enough sense to not stop, and definitely not exit the car, and drive my way out of it.

Never forget that your car is a 6000 pound battering ram, and also that road rage is not worth putting yourself in this situation to begin with.

Depends on the state. In Louisiana, the heat of passion defense mitigates murder to manslaughter. In other common law states, heat of passion (fights, situation we see here, finding your wife in bed with another man) can be a 2nd degree murder charge. It just depends what that state decides to call that specific type of homicide.

have to go to court and say " look, i've seen enough movies where the bad guy gets up after being shot a few times, i didn't want to be looking over my shoulder the rest of my life".

define no longer a threat. I could say maybe the idiot with the bat had a gun in his waistband that he didn't want to use at first, as his intentions were to just rough up the other guys car at first, then after he gets shot at and runs away he remembers he needs to defend himself with his gun, so even though he was shot in the back and fell, he's going to roll over and start firing back.

I don't care that he finished him off. yeah it's going to be difficult to defend it, but i would hope he would get zero jail time for it. Once you start shooting at someone, you should finish the job. You didn't bring the gun out and start shooting to scare them off. You brought it out to kill the guy.
