Trespassers in HOA pools are extremely problematic and a real issue with a lot of HOA's. I got no dogs in the fight nor all the details but i will say for everyone say "mind your own business" that if serving a role on the HOA board, that trying to eliminate trespassers is part of his business.

Having a card doesn't necessarily mean she's a home owner. She could have a card from an actual home owner in which the guests alone without them isn't typically allowed.

True but you should give them the benefit of the doubt and investigate later. Calling the cops is a disproportionate response to a minor offense.

FTR I don't think the guy should have lost his job, but neither do I think he was entitled to it. Act like an a-hole in public and your company could decide to cut you loose. This is the new social media reality.

He had no right to ask for ID. Hell, in North Carolina people are not even required to show ID to the police unless they are operating a motor vehicle.

I think you are confusing rights in a private setting verse public. He has every right to ask and deny access if it is a part of the HOA bylaws. She doesnt have to provide it, but she might be denied access

Although I agree, but sometimes conflicts evolve to that point. He should have taken the address and done some due diligence before demanding more proof and calling cops. if she has an accident, HOA's insurance probably wont cover her, if she turns out to be a guest and not a resident

Did you watch the video? There were rules posted by the pool which did not specify you had to show ID. Also, he didn't mention shite about bylaws.

this is simply not true. Most HOA policies cover liability for guests in common areas. Her medical bills would be covered as well. That's assuming she didn't cause her own accident.

In the video, the police officer clarified the HOA rules, and there is no ID requirement.

1) Each party must have a keycard.
2) Residents must sign in.

The woman had a key card, and the sign in sheet was not out (which means that nobody signed in that day). Given that nobody signed in, it does look an awful lot like this woman was singled out. Why? We can only speculate, but it doesn't look good for the HOA dude.

yet nothing about proving you are a resident. Which is why the key card is sufficient. Those are given to residents.

I doubt this is the case. You primarily get insurance for these situations.

I think it was been independently established by internet sleuths that the woman is, in fact, a resident of the neighborhood. It was simply her first time at the pool.

No he gave his HOAs rules, but all those rules also usually state a resident has to present, just like this one. You just might have to prove your residency

that's cute if you think that's how an insurance policy reads. and secondly, you can get sued for anything, defense costs are primarily the huge headache.
