It seems pretty broad. I am not entirely clear on who has burden to prove expressed consent given or not given and if given does this apply to multiple pics including ones at later dates and across various different social media than consent given.

I get reason, but I wonder if one person says expressed consent to send pics by text or whatever that night was given verbally earlier in day with no witnesses and the other says it was not given verbally with no other evidence one way or the other will law enforcement attempt to charge person sending pics? Will past behavior that is continued today be illegal without each expressing consent today?

Does it apply as strictly as written to husbands & wives? If a wife sends a picture today forgetting to get documented express consent and 6 months from now she leaves husband can he use this against her?

If they just leave it to judge or jury to decide 100% he said/she said express consent issues this will be used as revenge and/or to just set someone up they don’t like or agree with. If they only charge when it’s clear receiving person expressed opposition to receiving pictures and was still sent them it would lend to less revenge charges, but it was not exactly written this way.

I am mostly concerned about high schoolers and college students getting set up by someone scorned, wanting to discredit someone, or overly offended. I don’t think it has to be body or parts or action of person sending text, so I can also see group chats between kids also becoming a problem especially with ones where membership is constantly changing or how they let friends have access to phones and pics or posts are done in jest at times.

Below would be even worse to be charged with sending child porn to friends.
