Maybe my point was that you can't look at an action divorced of mens rea and say it is or is not a crime. Too many people in this thread have wanted to look at whether touching a holstered firearm counts as a crime without examining the neighbor's intent in undertaking the action.

So I was more just trying to provide a helpful comment on how DA's actually look at assault to the thread as a whole.

Too much much typing just so two plumbers and a Radio Shack cashier can tell you you're wrong, because the Honduran news channel said a man was arrested for touching his gun.

I'll tell you that no ADA in his right mind would attempt to prosecute a person for placing his hand on a holstered gun. It's not a crime. While the OP wont' answer anyone's question as to whether or not the weapon was drawn (and we all know why), there's a reason why the "police have done nothing."

You were told? You should sack up and go over there next time you see him, introduce yourself and have a conversation with him. If he is still a dick and you don't get anywhere then keep your eye on him and continue to alert the authorities.

You have to go by one of the Civil War shops and buy a cannon. Take the old wooden-spoke wheels off and get some 24"spinners for it.

Park it in your front yard by the house, aimed at his house. Peace through superior firepower, and whatnot.

Guessing this is how things went down.

Neighbor was somewhere near the vicinity of the OP's driveway and not moving out the way fast enough.

OP revs car and runs up on neighbor in an attempt to auto-bow up on him.

Neighbor calls OPs bluff and signals that he's armed.

OP retreats inside house and desperately attempts to get police and message board on his side.

Neighbor's behavior is odd.

I have neighbors who carry firearms all the time. Never had a problem with them. But they don't walk around with holstered pistols like idiots. Most have concealed carry permits and keep their firearms out of view.

Why wouldn't you just talk to him one on one instead of getting the police involved? If he continues to threaten you at that point, then you call the po po.
