Woah backstory please. I'd be worried that my neighbor took whatever disagreement to that level.

Most responsible and mature gun owners, don't let other people know they own a gun.

That's not brandishing

Wow. You are pathetic. Unless you are a woman. Are you a woman?

There is no such thing as "brandishing a weapon" in Louisiana. That aside, putting one's hand on a holstered weapon is not brandishing weapon. Had he drawn the weapon and pointed it at him, it would arguably constitute an assault with a firearm, a misdemeanor.

This:
is not this:
The OP is a bit oversensitive.
quote:
he put his hand on his sidearm and turned towards me
is not this:

It shall be unlawful for any person to point, hold or brandish any firearm or any air or gas operated weapon or any object similar in appearance, whether capable of being fired or not, in such manner as to reasonably induce fear in the mind of another

Was his piece on his side in a holster or tucked into jeans and he put his hand on it?
Or did he actually pull it out and point it at you?
What's the backstory here man

Do you live in Alabama?

How has OP not burned his neighbors house down yet?

Simple assault with a firearm by intent to cause fear or threat. It is a misdemeanor though. Now if he fired a bullet, whether it struck you or not, then that's Agg Assault.

The neighbor is probably checking out op's skull game on that sidearm right now.

Could be worse
I showed my neighbor naked pictures of his wife on my phone to intimidate him

He scratched his fricking hip while watching milf lady running on the sidewalk across from op's condo.

He was stupid enough to brag about scaring me off to some of the neighbors. Up until that point I was not sure of his intent. I was carrying at the time, but certainly didn't feel like I was in a situation where I lawfully could reciprocate in kind.
I am very serious about gun rights and the ability to carry for self defense. His actions were nothing but intimidating.

What started all of this?????????

Are you sure those people on the bikes werent fricking with you? They tend to exaggerate things.

Yeah, I had a few extra sentences in there going through different levels of assault and then pulled out everything but left the aggravated language.
It's a fact that putting ones hand on a holstered weapon (which is how I read the OP's post) is not an assault.

Walk into your house and go directly to the shower to wash the sand out of your vagina. The guy is your neighbor, go talk to him.
I feel like there is more to this story that you left out though.
