Covenants were enacted in 1980 for the area. It seems houses built 1980-1983 followed the rules. Houses built from 1984 to 2020 did not follow those set backs. When my problem happened, 4 others have gone through the process in my area and are getting the set backs now enforced.
The city told me I could file for a variance and go through a bunch of crap but we just decided to shrink the footprint and move on. We do know one house that just got built went through the variance process and paid a bunch of money but got it.

You should have spoken with him first. It probably wouldn’t have changed anything, but at least you could say you tried to handle it man-to-man FIRST.

But kudos for going back and speaking with him after the fact and offering a peace dinner; that humble pie still proves your a man.

To clarify I’m in construction and know all about surveys and set backs

This issue is that everyone is in line with the setback from the front servitude but independent structures (garages/pool houses) in the back yards and side set backs have been loosely enforced.
The city calls for 3’ set back from side property line and back property line. The covenants called for 5.5’ from gutter line over hang on side and back. This caused me to shrink the garage 2.5 feet from the back and 2.5 feet on the side which caused significant reduction in sf. I also had to reduce the driveway and car port size.

The first thing I would do is quit paying HOA fees. Why bother if they aren’t going to enforce their own rules? These HOA’s are usually paper tigers. They get threatened with a law suit and the fold like a cheap lawn chair

If its clear in the covenants and the hoo will not enforce then consult an attorney who specializes in this kind of civil law. Simple who else is with you on this make them step up also. You cannot ever get the guy to give in on your own. We lived a similar past only with kids and dirt bikes.Took a year but was settled out of court, and they left.
