Correct. Next time write an email to your HOA president noting the violations. Write another if in 30 days their is no resolve. The 3rd should be from an attorney notifying the HOA is not upholding its end for the dues paid to them. Next is small claims court.
Always protect your money. Never feel bad about it.

Went through the process, no covenants or anything listed on the deed. We go to get our house plans approved and the city approves them. Prior to building the woman next to the property had apparently been freaking out that we were building on the empty lot next to her that has been empty for years. She also took down our survey stakes at one point. Well it turns out this area is under civic association covenants with set back requirements different than city standards. But these covenants were loosely enforced. This woman reported to city about our layout saying it violated the set back of the civic association. We had to change our plans and everything. The best thing about this is that her house violates all of those set backs as well as all houses around me. People can be real Assholes.
You have legal recourse against whoever did your title search or the city. All covenants have to be noted to the title/deed. No exceptions or they are unenforceable

The trap was them asking me to contact the city...that became public record... I didn't know that until the ordinances lady told me.

You have try to see other points of view.
People don't like changes...that we know.
In this case we're talking about trailers that do not belong in front of houses in a middle class community...
That's the short of it...
In your case...you're the new guy on the block...who doesn't want to hear about rules..
Set backs are important...
No rules equal situations in the future no lawyer can fix later...
Boundaries and fences can make good neighbors.
Covenants are by design to protect home values

Not a single house around me is following the setback rule at all. The woman only brought that up to be an a-hole. Her house, garage and pool are all violating the set back rule. We have no documentation that this land was under these covenants when we bought.
The other neighbor on the other side of me couldn’t believe the way she was behaving.
My wife grew up a street over, living here her whole life and her parents built their house not following any of these rules and never knew about these covenants

Were they built before the setback was established? Again if there is nothing tied to your title tell her and the city to pound sand

As a builder I can't relate to not having set backs...permits and inspections, surveys...to validate
I've got all kinds of stories I could share.
I know its a pain in the arse and hurtful a new neighbor is making life difficult for you...
If they've been there a long time they probably hate the development around them.
Older people like space and no construction....they want no change
If its happening next door they want to have a say...
I Dealt with an issue like this last year in downtown Apex....my client received resistance from 3 neighbors...
