consider two scenarios

#1 the kids are playing near the water, startle a snake, the other kid gets bit.
#2 the kids are playing near the water, see a snake, your kid comes and tells you about it, you send your kid back over there with instructions to kill the snake, the other kid gets bit.

#1, shite happens
#2, you have partial if not full responsibility

You’re fricked. How much is the liability coverage on your HO policy and do you have an umbrella? If not, prepare to have wages garnished

You're very much fricked, why didn't you tell the kids to leave it alone or at very least give them a fricking shovel? You're just lucky the kid didnt lose his foot or die.

Trust me if I could do it again I would have just give them a gun out the safe.

Really worried that I won’t get to go to my boys fall ball games

Do you realize how expensive antivenin is? I don’t think most insurances cover it either. This is why you are being sued. Also bc you were negligent and it wasn’t even an accident.

You assumed responsibility when you sent them out with a hatchet.

Try to settle out of court.

Long story short my son and his friend came running into the house saying that they found a cotton mouth near the edge of the pound while they were fishing. I gave my son a hatchet and told him to just take care of it. Minutes later my son comes running back into the house saying that his friend had been bitten.

I'm just quoting this for the subpoena.

After reading your replies in this thread I think the other parents are negligent also for leaving an 11 year old under your supervision

After the kid spent a couple days in the hospital, many viles of anti venom and almost losing his foot the kid is mostly okay except for a little nerve damage.

Little nerve damage? You just said he almost lost his foot. That ain't "a little" nerve damage. I would imagine kid will need a lot of PT to regain full function of his foot.

And like someone else said...antivenom is EXPENSIVE. It can cost up to 10K or more A VIAL. You just said they had to give him many vials. Maybe their insurance won't cover the antivenom.

You fricked up big time and the parents are totally justified for suing your idiot arse.

A gun? Geez dude. That's worse than a hatchet for a deadly snake. I really don't think you get it.

You are an idiot to send a kid to kill a cotton mouth with a hatchet.

It’s not real but you are still an idiot.
