Why not make the loser - insurance company or party / attorney bringing suit - pay the costs & legal fees of the winning side
Great idea, but the insurance companies lobbied AGAINST this in the 1990’s and had it taken out. Delay of legit claims is a tactic, just like bringing frivolous claims is a tactic.
We, the insurance paying public, get screwed over. There should be a cost to those who delay legit claims or bring BS claims.

Then don't get a lawyer and see how far ya get. Most people don't need a lawyers to see a chiropractor for 2 months and send the adjuster the medical records.

No clue, just as I have no clue what percentage ever needs a criminal defense attorney. But I don't see how that's particularly relevant. Of the population that needs it, what percentage can afford it? If the percentage is low, there's your answer of why PI attorneys are allowed to structure their contracts the way they do.

I don’t know how an average people afford a lawyer for anything paying hourly out of pocket.
Regular lawyer rates are crazy high across the board nowadays.

The majority of lawyers plying their trade, at almost any moment in time, are engaged either in the circumvention of the law, the exoneration of criminals, the deconstruction of the letter and the spirit of the Constitution, the distortion of objective reality, legal blackmail, the overthrow of discernible truth, the manipulation of the ignorant masses, or the defeat of justice.

So if they lose, they are only out a few hours of their time and a few filing fees. Meanwhile defendants are out thousands more and their ability to clawback any money from frivolous suits is hampered by the legal system.
If it's a case of any consequence, they've put more than a few hours into it.
As for "a few filing fees", these days you need experts for most cases if they're worth anything. If a case goes all the way to trial it would be very unsurprising if the plaintiff lawyer ends up spending 20 to 50 grand.

Your insurance company doesn’t settle a case without having the plaintiff sign a release of all claims against you. So either you are being bullshitted or you are bullshitting us
