Just think if when filing suit meant the attorneys were also on the hook for frivolous suits too. I am pretty sure attorneys would pick better cases to litigate.

Lawyers are also self regulated by lawyers as opposed to the Insurance Commissioner is elected by the electorate to regulate insurance companies. The LA Supreme Court and Attorney Disciplinary Board regulate attorneys and now Landry wants to appoint the Insurance Commissioner so you would get another lawyer appointing a fox to guard the henhouse.

I've always assumed most of the lawsuit settlements are negotiated out of court. I would think the big plaintiff and defense firms have access to shared databases that list the range of payouts and all the variables for the different cases.

My son bumped- key here is BUMPED- into a car at the I-10/Clearview Exit.
He said traffic was stopped, started creeping forward, jackass in front of him abruptly stopped, son touches the guys bumper. No damage to son’s car whatsoever. But they did touch. No denying it.
I tell him to call the police- nothing good can come of this.
Our insurance gives this clown $3000 in damages for his car. Denys his medical claim.
We are now being CIVILLY sued by this fool- and one of these billboard lawyers took the case.
The best part is that I am hard headed. I will fight this all the way to trial. We are lawyered up- and I promise we have more resources than some half bit billboard guy.

Personal Injury are all terrible humans. Scum of the earth.
But the worst thing about them are the fricking commercials. I have that stupid fricking Dudley Debossier song in my head more than the BK have it your way song. frick them for that.

They won't go away or change as long as they can file a full fledged lawsuit on every claim, no matter how small or frivolous. It's staggering how many auto suits get filed every week in this state. Once they get a claim into our state court system they will recover.
You have to regulate the ability to file these claims. Either put all of them into a separate highly regulated system with no juries like workers comp, or make each claim subject to pre suit review like med mal. You'll see fewer billboards if you do this.

Was advised to get one by insurance adjuster couple years ago. Get the best people told me. Complete waste time and money. Don't dial .

Not even close. I would never do personal injury work or work for an insurance company. Anyone doing either has no soul and feeds off of taking advantage of people while pretending to help others. They are both hypocrites and the bain of existence.
But I can guarantee the way to a better system is not to ensure we move all of the power away from one of those and move it to a system that ensures insurance companies will have all the power. That is as dumb as tort reform has proven to be. It has never led to lower insurance rates and never will.

I am not dumb enough sheep to think giving insurance companies more power is the way to solve things. Just like I am not dumb enough to think removing all restrictions on the plaintiffs bar would help things.

You mean your insurance lawyered up. Your resources don't matter your insurance will settle this before trial. Your insurance does not care how hard headed you are.

You know what I liked to do after a big case had worked its way through the system? I mean a big one with some zeroes on the check, one that grinds on for 18 months or so and all the lawyers involved hated each by the end?
Instead of sending a runner over to pick up the check I liked going myself. I'd sign for the check then ask the girl if you were in? of course you were in thats how you guys make money, sitting at your desk or taking depositions . So then I would stick my head in the door and savor that horrible look on your face and watch you try to recover. And then chit chat, "great working with you" "your wife takes a spin class at NOAC?" Just chit chat.
But, you have to look at that check in my hand right? So while you are sitting there wondering if you can afford to keep your kids in private school you know in 2 or 3 days I'm going to be in Italy or Greece, and you will be taking a chiropractors depo. I really enjoyed that. Shitty? sure, but a nice way to put a bow on our time together.
I hope you enjoy your retirement. Life is good once you get out of the trenches.

Nope- auto insurance already settled with him and denied medical.
Now he is apparently filing a civil suit against us.
I thought once he got paid by the auto insurer, that was it. But apparently he has retained a billboard lawyer to sue us now.
